You are right to be indignant at the way the elite has and is frittering away state resources but you are wrong to be focussing on only one party in this particular case. Are you satisfied that a public official will enter into a high-stakes transaction, as was done by Mr Tsikata, in which he confessed he had no expertise? His excuse was that he was not the one who approached Societe Generale but rather SG approached him. He further said that they promised to train GNPC staff in derivatives, after the contract has been signed.
Mr Thompson, would you sign an agreement with a salesman, who knocked on your door, selling a service you do not understand on the promise of training some of your children afterwards to understand the service? You will not and such is the cavalier attitude of some of our elite to recklessly incur liability for the state. A good CEO would seek independent advice before entering into such a contract.
With those who settled the case, it is also legitimate to ask questions on why they settled. They have volunteered to appear before the Sole Commissioner, so why don’t we wait to hear their side of the story?
It may not be true that the case which was litigated in the US was the same as that litigated in London. The US case was to detain the ship whilst operating in Mexico. I do not know the details, but it may be that the US declined jurisdiction. The London suit was to recover a debt of $47m dollars, for which the ship had been seized. If a court granted that the ship be seized, it means there was prima facie case established that GNPC did in fact owe Societe Generale.
Have you also for one moment tried to put your self in the shoes of those who agreed that the ship be sold to liquidate the debt. They were facing a potential (I did not say certain) adverse ruling to pay $47m dollars; they had mounting legal costs, which at the time was in arrears to the tune of £500,000. There was a further estimate of £700,000 to completion. There was the risk of Societe Generale being awarded costs against GNPC should their case prevail. Each day that the ship was detained, the cost of keeping it was also accruing. So this scenario was also a gambling position, also giving the fact that GNPC owed other foreign banks and could not even afford to pay its workers at the time. It could have cost the state double the amount in question or nil, if GNPC were to prevail. In such a scenario, would you settle for $19.5m? I want to throw this out there among our considerations.
But seriously, until we are prepared to hold all and everybody accountable, this throwing of blame at one side or the other will never help Ghana. When we do that the actual issues are clouded to be overtaken by politics. We then allow the same elite we are complaining about room to wriggle out.
By the way I support the call for the remaining $3.5m from the sale of the ship to be traced. I have no doubt that this would be the preoccupation of the Sole Commissioner when Messrs Kan-Dapaah and K T Hammond appear before him.
