I do not know the lawyers that you have encountered but I can categorically inform you that your statement is a fallacy. What you need to do Danny, is to instruct lawyers on recommendation only. There are very good and highly professional lawyers in Ghana. There may be some not so good ones but for you to say "most" Ghanaian lawyers are fake is oompletely off the mark. Please be aware that this is a very honorable profession that expects the highest of standards from all its members.

Mr Gyamfi, whilst I share the lack of compensation for victims of accidents and others abuses in Ghana, I do not believe that the answer lies in copying the system in the US, where sometimes parents and children sue each for any family disagreements.

What Ghana must do to ensure the victims are compensated is simply, enforcement of laws, rules and regulations (the lack of which that leads to corruption). If that is not done before your suggestion is put into action, then lawyers will claim the compensation but the money will not reach the victims. If you have been following the Judgement Debt Commission hearings, you would have known that this happened to the family of a man who was wrongly killed by the police. Though the police through the Attorney General's department paid the family compensation, the money never reached the family and no none knows who received the money. That is why the family went to give evidence to the Commission and asked for assistance to trace who got the money

Again, in the US and the developed world there is "Conditional Fee Agreement" or what is commonly known as "No Win, No Fee" as well as legal aid. Therefore victims who cannot afford the cost of seeking justice can go to court through such arrangements. I am not sure if such arrangements are easily available in Ghana. Last but not the least, there is the problem of education or awareness. Many of the victims in Ghana do not even know that the owners of the vehicles and boats involved in accidents can be held accountable for the accidents caused by those they employ, whether they have insurance or not. Unless the victims are aware of the the rights and responsibilities as a society, then, even with lawyers advertising their services, patronage may be limited to the few who are already aware of their rights and responsibilities.

I can tell you one thing which is that the people that suffer these injustices must first of all be made aware of the fact that their legal rights are being infringed. As at now, the supporting structures that are needed to raise the awareness of our significantly illiterate population are nonexistent. Having said that, the first thing any aggrieved individual has to do is to go and see a lawyer and not their chiefs or religious leaders. I can also say without any reservations that there are more than enough very good lawyers in Ghana ready to assist any client that properly instructs them. With regards to your suggestion that lawyers in Ghana should advertise their services via the media, the last time I checked, the Ghana Bar Association prohibits us from advertising our services as the Association is of the opinion that advertising "cheapens" the image and integrity of the profession. I personally disagree with this viewpoint and personally will soon raise this issue with the Ghana Bar. But like I said above, I am not too sure if this is still the situation in Ghana with respect to the stance of the GBA. If it has changed, then my apologies but if not, then that is one of the militating factors that your suggestion faces.

The mentality of prestige is what is killing our community? Why should they think of "cheapening of image"? It's the work that they must do not seeking glory. Some people are even afraid of the law court because of lack of information. Lawyers must galvanize to break the strong arms of injustice.

Mr Author, I hope you did not misinterpret what I posted. I did not in any way, shape or form allured to the idea that prestige is of any importance here. What I expressly stated was that this is the viewpoint of the Ghana Bar Association. I even went a step further to state that I personally intend taking up the issue with the regulating body. Glory comes to the profession as a matter of course, lawyers do not need to "seek" it. You are however correct in demanding that lawyers must do their utmost to eradicate injustice. Fair point, but it is more down to the Judiciary as a whole particularly our judges to spearhead an onslaught on injustice.

The idea that that advertising cheapens the image and integrity of the law profession is now archaic and no more required in the UK where the Ghana Bar copied its rule of ethics.Those rules have been changed for something more progressive and now allow advertisement for lawyers.It is high time the Ghana Bar move along and change this outmoded rules and grandiose picture of themselves.

One good reason why advertisement is good is that lawyers will project areas of their speciality unlike the present case where lawyers take cases even though they have clue what it entails.Competition and specialization is good for quality control.
