4. Kan dappaah himself admits Societe Generale were prepared to accept some 12 million US dollars and ven settle for a still lesser amount while negatiating with their NY rep...what happened in the meanwhile to send the amount balloning finally paid to over 19million US dollars?
Let us all show a lot more concern over what politicians and top civil servants do to damage the Ghanaian economy ratger than focus narrowly on someone who was actually trying to invest (even if misguided or things went wrong)...rememember Sam jonah did something similar to Obuasi (Ashanti Goldfields) with much more disastrous comsequences.
If you have access to inside information bring it all out into the public domain. with a little financial literacy most people can access such information and make informed decisions (opinions) about what really happened.

Tell me what Ghana should have done to get the ship that was used as a collateral and has been seized by the creditors.
Tsatsu has even admitted GNPC did not has liquid assets at that time to pay SG.
It's said Listening to you Ndc people, the same people that defends Ndc officials who refused to go to court when Woyome brought his fraudulent case to court and just handed him $30 million dollars without even a contract.
The case here is a legitimate debt caused by Tsatsu's stupidity. Tsatsu should be in prison for causing financial loss to the state.

The Judgement Debt Commission will never get to the truth regarding this drill ship episode. Unless NDC and NPP to seeing anything and everything in the political prism, Ghana is getting nowhere if not backward. Despite the acrimony between the Democrats and Republicans in the US, when it comes to fighting corruption and wrong doing against the state they come together to get to the bottom and hold those responsible accountable.
The fact of the matter is that Tsatus messed up as Chief Executive of GNPC. He lost control and did not have a clue as to what he was doing. It beggars belief that a lawyer of his calibre could behave the way he did as indicated in the correspondence referred in SARPONG's article. He irresponsible and negligent. He was able to do what he did because he had absolute power with the support of Rawlings. As far as Rawlings was concerned, Tsatsu was/is always right and even was able to overrule Kwesi Bocthwey on financial matters despite the fact he was the Finance and Economic Planning Minister. He was also able to overrule the Governor of Bank of Ghana and get whatever money he wanted for whatever he wanted to do. I cannot understand what Tsatsu did at GNPC and those NDC guys who are defending him, must put on their thinking caps and be objective. It's not about Tsatsu, Ken Dapaah, KT Hammond, Akufo-Addo, NDC or NPP but Ghana.
Then, the other argument about how the sale was conducted is done with no objectivity. For me, there are questions which are not being asked. For example, how much was the ship bought for by GNPC and at the time it was sold, how much was the market value? Tsatsu claimed it was making money for GNPC. If so, how much was it making per day/month or annum less expenses such as maintenance and staff cost, etc? At the time of the new government decided to sell the ship and settle the claim by SG, were there other better options?
The decision by the government to change the solicitors representing Ghana/GNPC. Was any due diligence undertaken and was the appointment of the new solicitors value for money? Was there not conflict of interest when the new firm of solicitors appointed was the one Mr K T Hammond used to work with whilst in London? Did he benefit directly or indirectly from this arrangement?
Last but not the least, the disbursement of the money, particularly the $3.5 million, why did the cheque ended up with the Ghana High Commission in London and why was some used to pay staff of the High Commission, why the records regarding all these transactions were not available to the appropriate agencies and state institutions and finally how did they all of a sudden end up in K T Hammond's pigeon hole in Parliament?
These and others are matters that should be of interest to all Ghanaians, irrespective of one's political affiliations.
When all these matters have been sufficiently addressed then if further actions must be taken against certain individuals for negligence or whatever, then they ought to be taken, again, without fear or favour. This blame game between NDC and NPP is counter productive inimical to Ghana. Nothing will come of the Judgement Debt Commission's work as long as NDC and NPP are concerned because any further action will bee seen as political and most likely to be against those on the side of NPP. NPP will be right to consider any such action in the future as politically motivated, if Tsatsu is left off the hook. He was prosecuted for other matters but not the drill ship and nothing should stop Ghana from prosecuting him if he was negligent in causing this mess. Sadly, I do not see that ever happening in Ghana.

Having said that, I'll quickly add that at this juncture in our history, we really do need what has been called, Special Prosecutor by the Americans, to wade through the Drill ship saga and severely prosecute all those found guily. Mr. Martin Amiuu would be a fine Special Prosecutor.

Ghana’s Judiciary System was at peace with itself before Jeremiah John Rawlings and his Revolutionary PNDC came to power through coup de tat in1982. It had its own challenges like many of the State Institutions but was doing very well with very good Judges of high pedigree as well as very good and capable Old and Young Lawyers. The Law Reports were in full publication and the Legal System was largely unaffected by the excesses of the Military Rulers: BUT all changed when the hot headed agitated excitable miscreants overthrew a Constitutionally Elected Government of Dr Hilla Limann and PNP Government. Rawlings says he did not interfere with Ghana’s Judiciary system and no one serious politician or lawyer can stand up to him and tell him its White LIES, as portrayed here:
1. RAWLINGS PNDC put a great fear in the hearts and minds of the Country's judges and magistrates by murdering Three High Court Judges in cold blood and then dump them in mass grave for inexplicable reasons. PNDC committed those heinous murder that signposted their war against the country’s Judiciary system, and after that, so many Supreme and High Court Judges fled the country, some never to come back to their loved ones again.
2. RAWLINGS PNDC chased so many good upstanding brilliant lawyers into exile, prison and untimely death. They were many and I won’t be able to call names now, but it happened. We all saw it! The PNDC machinery drew a hit list and took these lawyers apart in a way that shocked me to date. I saw it with my own eyes, so many good, rich, successful and very intelligent lawyers who had done nothing wrong being chased around like terrorists. PNDC slaughtered lawyers between 1984 and 1988. They were a huge repository of knowledge to the country’s heritage of law. Ghana lost very good human resource. May their Souls Rest In Perfect Peace.
3. RAWLINGS PNDC then established his own Judiciary System - National and Regional Public Tribunals that ran and ran for years, doing all the big criminal cases in the country. Under the tutelage of Tsatsu Tsikata, Ato Dadzie, Kwamena Ahwoi, Atta Mills, Justice Kpegah, Tanoh, under the Chairmanship of Kojo Tsikata, the Tribunals became a law unto itself. They promulgated their own Decrees to investigate and Prosecute Accused persons in their own court systems and procedures. Many Ghanaians suffered under their arbitrary quasi-judiciary system of obnoxious practices with George Agyekum, Addo Aikins, Eric Nyavor, Senyo Dzamefe, Anning, Aggrey Boakye Danquah holding court.
4. Ghana BAR Association, for years, opposed the machinations of the country's Judiciary System by Rawlings PNDC, and boycotted the proceedings of the notorious Tribunals. Accused persons were left defenceless at the mercy of treacherous Special Prosecutors of Bright Akwetey, Thomas Alhlijah and poisonous Amonoo Monney before largely inexperienced Tribunal Chairmen and their Laymen Panellists, who imposed draconian fines, penalties and extraneous imprisonment terms on frightened Ghanaians. It was a dark spot in the country's Judiciary history. All the fines were lodged in PNDC Account 48 at Ghana Commercial Bank. It ran into several Billions of Cedis, but up to date no Ghanaian except Rawlings, Ahwois, Tsikatas, Ato Dadzie, Gyan, and Isaac Duose...know how much was in this Account, and what they did with it!
5. Rawlings PNDC left the Courts to rot: The buildings fell apart with no paint on their walls. Throughout the Regions and this very Supreme Court, the place stank of urine and damp air, with windows in rust and furniture broken. No single computer was purchased for the Judiciary, as the age old type writer creaked and rumbled on until NPP came to Government to restore sanity into the much abused Judiciary system!
Jerry Rawlings has set out to review his own lack lustre regime that wasted our time, but he chooses what he wants his gullible followers to swallow: But for some of us, we get shocked to hear such white lies from this man. The truth will however be told that RAWLINGS PNDC nearly totally destroyed Ghana’s Judiciary System!

Justice Apau's demeanor when questioning Dapaa and Hammond clearly shows that he had concluded that it was improper for the government to sell the ship without a board approval. Additionally, he has concluded that SG got a better settlement because of the default judgment it obtained. This is what his findings will be regardless of all the numerous documents to the contrary. This explains the childish and self-serving questions Justice Apau and counsel for the Commision posed to Tsikata. Apau has lost his credibility as a fact finder and he is therefore a joke.

Our executive branch and our legislative branch helplessly sit on the sideline and occasionally participate in trying to sway the public. Our judicial branch, on the other hand, does not want to get involved in the conflict which is becoming too frequent. Our fourth estate, has not helped either. In fact, on many occasions they have aided and abetted the political conflict.
I'm therefore calling on our Chief Justice to intervene in the aspects of the conflict, just to save Ghana. For example, she should do every thing humanly possible to get to the bottom of the sale of the drill ship. The accusations and counteraccusations from the pundits from both NDC & NPP is just muddying the facts regarding the sale of the drill ship - because the case might involve "some big people" in both parties.

According to your own article, in the concluding part of the so-called correspondence, Societe General themselves sounded tentative and unsure about the source of repayment so how can you say Tsatsu lied when he said the drill ship sale was not part of the agreement... For crying out loud, the man didn't even respond with any confirming or impliedly confirming letter so what is the basis for this accusation of lying? Be reasonable and stop defending the indefensible my friend. Akufo Addo instigated the sale of our only drill ship when he had a chance to protect it in court. See how the table has turned.

If he did not use the ship as collateral, why talk about it in negotiating payment of your debt? And who told you Tsatsu did not respond to their earlier letters? How would they have had the payment plans Tsatsu wanted to live on and his plans of selling the ship? Tsatsu was just trying to avoid them later because GNPC was broke and he has no money to pay the debt and still keep the collateral he used to play the oil futures he has no knowledge about.
Tsatsu in any other country would have been prosecuted and put in prison for using company assets without any authorization from the GNPC board.
Sad Ndc members even have the audacity to talk about this issue when they have caused the country to lose about a billion dollars in GYEEDA, SADA, Sabu infosolution, ports, Woyome, etc scandals and are talking about 3.5 million dollars which is even had been proved was deposited in Ghana's account in London.

As at now no such letter has come forward. So stop the conjecture. Did you not hear Tsatsu say that the money GNPC specifically took from Societie General was an UNSECURED credit line? so what mortgage-ship contract are you referring to ? Or you don't understand the banking term "unsecured"?

I am patriotic enough to admit those people who sold the ship should unravel what happened to the $3.5 million.
No matter how much you cry, it is an undenying fact that, Tsatsu stupidity caused this debt.
Secondly, Tsatsu has admitted owing this money on behalf of GNPC and had negotiated the amount down.
Third, it is also true that SG legitimately seized the ship in Oman and was going to sell it to settle the debt Tsatsu caused and Ghana was going to lose the ship anyway you look at it.
Yes Tsatsu said he did not use the ship as collateral but anybody with an ounce of brain in their head can tell from these letters where Tsatsu promised to sell the ship and pay SG and the so called mortgage contract he signed on the ship with SG that, he actually used the ship as collateral.
Do you really believe an International company like SG. will go around seizing properties it has no legitimate claim on with the dire consequences such a mistake can cause the company financially and its reputation?
If you want to respond, address the three points I asked instead of telling me what Tsatsu told Apau because he lied as the letters here show.

Any intelligent mind should know that 'letters of claims' from SG does not make Tsatsu or GNPC liable. Claims incorporated into letters does not represent a contract or a prior agreement. Therefore such claims are contestable and could be challenged and defeated. That is why the absence of corresponding or prior agreeable letters from Tsatsu leaves those letters from SG as mere claims that is there to be contested and not effected.
