Mike, there is nothing wrong with challenging the views and opinions of IMANI collectively as well as individually. However, to refer to IMANI as Shit Thank is unfortunate and in bad taste. The response of Franklin Cudjoe to the High Court ruling was very disappointing and in fact, betrayed the credibility and impartiality of IMANI as a Think Thank. His response showed that either he was unaware of the reasons given by the judge or refusing to accept that the judge gave reasons.
I heard a summary of the reasons given by the Judge from the host of Newsfile this morning and there were substantive. I would have expected Mr Cudjoe to have read or be aware of the reasons before commenting on or challenging the ruling. His response also betrayed his judgement because he failed to say what was wrong with the reasons given by the judge.
I am not sure whether Mr Cudjoe is a lawyer but it appears to me that Ghanaians are mixing value for money and the law. As far as the law is concerned, it seems the judge was right. However, as far as value for money is concerned and specifically with the sale of Merchant Bank, Ghanaians have been short-changed, especially, if the Fortiz deal is compared with the earlier one from the South African Bank. I believe that is the issue at stake and that is why the sale is being challenged. The question is, is value for money or lack of it criminal or unlawful? Probably, yes, because it is tantamount to causing financial loss to the state but that is not the basis of the challenge. Let's wait and see what the Appeal Court says.
