If you look at the Supreme Court ruling as factual, you will get the wrong impression as this Kwesi Kwaku guy but the SC in not trying to waste anybody's time after looking at Woyome fraudulent papers just applied the basic law here. Woyome never had a contract technicality rule, PARLIAMENT NEVER APPROVED IT.

The SC did this because of Woyome's own assertion that he didn't have contract per se with the government but the company that sought his services was contracted with the government. Woyome is a SHASTA and you treat Shastas in shasta law.

For those of us who have been following this case from the beginning, we know Woyome just wanted to defraud the state because the contractor who sub contracted with Woyome came out and said they had paid Woyome for the services he rendered to them and they or the government do not owe him.

It's so amazing how Woyome did not take this case to court during Npp time when the said contract was abrogated but wait for a friendly administration that did not go to court but rather decided to settle this case with him after he Woyome has used some money to bail ndc government out in sending ndc soccer fans to South Africa to watch the world cup in 2010.

This money was just a reward from Ndc to Woyome for sending ndc soccer fans to South Africa.

Woyome branded a letter of recommendation from a deputy Minister when seeking a loan from Bank of Austria as a contract despite the fact that even in the letter of recommendation, the deputy Minister made it clear to the bank that the government is not responsible for any loan granted and it is based on that letter the SC ruled that the said contract was not approved by parliament.

First, let me make a comment on your name. I know of Kwesi Kojo (who was born at Sunday midnight and the parents decide to give him the names of the two days). Yours is a bit difficult to understand unless your mother was in labour from Wednesday to Sunday. Please let's note that Ghanaian or Akan first name have meanings and significance and therefore we should not trivialised them.

Now to the matter you raised in your article. I have not read the written decision of the SC but the fact is that Woyome NEVER had a contract with government of Ghana. He was a sub-contractor for Waterville, who initially had a contract with the government of Ghana.

Waterville and Isofoton were contracted by the then government of Ghana to deliver some projects for the Africa Cup under an agreement. The terms and conditions of the agreement included a clause which stated that, the agreement would come into effect after approval by parliament. However, before the government could take the agreement to parliament for approval, it became clear that both Waterville and Isofoton were having difficulties raising funds to deliver the projects and the government decided to cancel the contracts and re-awarded them to a Chinese company. This was because the projects not being ready on time could have embarrassed the government as the Africa Cup could not have been postponed. Waterville and Isofoton were paid for the work done at the time through the Chinese company (Quantum Meruit). After the government cancelled the contracts with Waterville and Isofoton, there was no need to take their agreements to parliament for approval. Instead, the government took the new agreement with the Chines company to parliament for approval. NDC is only trying to blame the Kufuor government for colluding with Waterville, Isofoton and Woyeme for fraudulently and criminally duping the state. They all knew that all the three never had a biding contracts or agreements with government of Ghana and yet they went ahead and paid the claims.

In conclusion, no none had been punished for the failure of fault of another. In other words, the situation you described in your article never arose.

Kofi falsely assumes that since there was an agreement that the contract will come into effect only after parliamentary oversight then that is set in sones.equity does not allow the law to be used as a conduit for fraud and so when the law is used to gain advantage and the process is abused for one's benefit and selfish ends then the courts should use equity to cure it for the sake of justice.

The latitude allowed by the courts to remedy abuse through the use of both the spirit and letter of the law to arrive at decisions is what makes the law what it is.The quest for justice is always the goal and not statutes set in stones.

The problem with you is that you think contract is something palpable and that it has a physical presence, it is NOT. Contract can only have a physical manifestation and NOT presence. At the minimum, it is your intention and given consideration of an offer which establishes a contract. Under the law, you bind yourself to a contract by your own actions and reaction.

One does't need to accept an offer before a contract is established. All one need to do is to signal your intent and give mere consideration and a contract is established. That is LAW Read the law on contracts, common law and statutory law alike. After that read the procurement act well. A contract is established upon conclusion of the tender and NOT after parliament approval. Tender carries series of steps also construed in the legal sense as 'consideration that has been given' by a contractor or subcontractor in response to the opening of open tender process or any other offer from the state that signal the states intention to enter into a contract.

How did the Government deceive Woyome? As an astute Business mogul as Woyome would have all see him, one would think he had competent Lawyers to confer with on Contracts of that magnitude. So, would his Lawyers be so clueless that they would not see through any deception by the Government?

But to sum up all this just consider this: If someone buys a stolen item from another and the one is caught with it, the Law does not allow the purchaser to keep it. Period!

Woyome can still sue the government for a breach of "good faith" and claim some compensation; for the sector ministry failure to present the contract for parliamentary approval. It is the contractors responsibility to ensure that all I's are dotted and T's are crossed do that they get paid after they render the service. Fur diligence is done by contractors aol the time so it is not something new or impossible for them to do. In this case wayome is feigning negligence to justify his attempt to defraud the state and the judges were not going to allow that.

Even if it is not legally criminal, it is grossly immoral in a poor country like Ghana. That is even all the more reason the money must not only be paid back, some people must go to prison for this!!!
