If Ben Epson's analysis of the electoral Petition is your standard then you have sunk low indeed. I thought you gave up your silly political commentaries to concentrate on your medical practice.

Dr thanks for your comments. It seems you are somehow sure that if certain things are done, elections can be without flaws. You know that it is humans who are infallible that do the voting not machines which can fail also unexpectedly. So let's getting this thing right that it is only when elections are without flaws that a certain political party can win. No. What is all political parties need is broad base following by the people of Ghana. NPP needs to build itself among Ghanaians and stop relying on courts to win elections. If you win 2 regions you are too far from winning the whole country. Too little this is for you to go to the Flagstaff House, NPP. Work hard and stop propaganda.

To terms with the desperation of certain individuals to win power.
Ben Ephson`s book, will surely shed more light on the humomgous fraud that was orchestrated by 'bad losers',to reverse the true will of vast majority of Ghanaians. Some of the principal architects of the dubious undertaking[the petition],have become mere footnotes of our political history, but others remain, who have resorted to all kinds of mischief to undermine the forward march of our great country. My bold prediction is that, they will certainly fail, but a lot depends on what the current administration is able to deliver,by way of fulfilling the promises it made to the people of this country!
The 'big' successes will make people overlook the minor flaws such as Returning Officers, not appending their signatures to record of results of votes validly cast, insignificant!

Whilst that may help, because of the rivalry between NDC and NPP is almost near to fundamentalism, it will not completely remove allegations of fraud by the two parties if the results do not go their way.

It is interesting that Arthur Kennedy has chosen to 'resurrect' the issue of the last presidential polls in Ghana. This is a very emotive subject and frankly there are many who would rather this 'sorry saga' and its costs to the nation were 'buried' from the memory as a 'bad dream' for all.
That said, I think all one can argue for such a debate to be had (apart from reviewing Ben Ephson's book) is that we might learn lessons going forward. I have always argued, and continue to do so, that indeed the ballot was won by the ruling party at the ballot box and in my view, it would have been a travesty of justice had the declaration of victory been overturned by the Supreme Justices. We can only imagine the permutations and combinations of decisions they would have had to grapple with, not to talk of the potential for chaos in any attempt for instance to hold the ballot again. I would also argue that the presidential ballot could not be then held without calling into question the validity of the parliamentary polls, and then we probably would have still been in court by now, trust me.
Any how, I wish to simply respond to your two first points as follows:
1 who removed the allegation of fraud when the petition went to court? If fraud was the primary basis of the initial complaint, and if it is the petitioners who took the matter to court, why in their submission did they EXCLUDE fraud from the case? Could it be that they lacked the evidence to back that claim?
2 As Justice Gbadegbe summed up in his ruling, if the “evidence of the petitioner who was not at the polling stations “cannot be preferred” what it tells me is that what the petitioner is alleging is based purely on HEAR SAY, and not on actual facts as he was not there, and indeed those who WERE there had testified to the contrary. If the petitioner was depending on other witnesses e.g. NPP (and other party) polling assistants/observers’ reports or testimony to testify, why on earth did the petitioner not invite those very persons who were THERE at the polling stations to take the witness stand instead of he himself?
Indeed Justice Gbadegbe makes this point further down when he questions why no witnesses present at the polling stations and who presumably were the source of the report/complaint that there was voting contrary to the statutory provisions were not called?
I wish to leave it there and not comment further to your article. Suffice it to say that many mistakes were made by the petitioners and in my view, even their presentation in court was poor. You question why it took so long to conclude the Ghana case. That could only be because the petitioners wanted it to be so, for their own good reasons and frankly their behaviour was in bad faith in my honest opinion.
They had a very poor 'star witness' and how they could rely on a single witness whose credibility and intellect to me had been called into serious question on the witness stand, and how they could rely on one counsel to interrogate all the defendants (when the other side had a 'team') was in itself a measure of how serious they took the matter.
For me the most disappointing aspect of the ruling was that any of the supreme justices could rule at all in favour of the petitioners. I found that aspect quiet shocking and to this day, I have serious doubts about the soundness of their arguments. I also found that word for word, chunks of some of the justices' reports I had previously read in the media including this forum from Ghanaian's who were on this forum arguing as "experts" and constitutional lawyers" mostly for the side of the petitioners. That to me is particularly worrying for our democracy.
I pray to god we do not find ourselves in this mess again, for it has set our development back quite a number of years, not to talk of the economic costs to the nation.

Mr Kennedy, you don't need Mr Ephson's book to cover the most stupid elections petition.Nana Addo,Bawumia and Jake the petitioners also know very well in their hearts that NPP lost both the Presidential and Parliamentary elections fairly. They only used the petition as a strategy to fool the NPP supporters and members so that they can lead the party in 2016.NPP shouldn't have given Nana Addo another chance because even if he wins the NDC will also refuse to accept the results.Thank you.

It is simple as ABC that on two occassions in the history of our country Nana Addo attempted subverting the will of the people in the courts.(2008 and 2012 ).
With all its flaws discerning minds knew the election results reflected the will of the people. No party in Ghana is sophisticated enough to rig elections in over 200 constituencies simultaneously within the full glare of the electorates.
It is fundamentally impossible, not even with the connivance of the EC. To me Nana Addo lost the elections during the debates. He came across as someone who had no grasp as to how government machinery works. It came as a surprise to see an ex cabinet minister struggling with some of the questions.
Elections in Ghana are won by the swing voters. They are mostly sophisticated in their thought process when it comes to elections.
Irrelevant rhetoric and side shows do not feature in their decision making. It is the truth and the practicality of the manifestos presented before them that matters.
Nana Addo does not portray an aura of being that smart. He might be a good lawyer in the midst of mediocre players in the legal fraternity. However in the plethora of minds that abound in the numerous professions in Ghana he is just an average guy.
He is not gifted cogntively. I might be wrong but that is the opinion formed during the debates. He was thrashed by far by JDM.
JDM was a better candidate. The CPP guy was the man that took the show but his party was not strong enough to sell him to the electorates.
