Such objectivity is needed on this forum. Emile Short and all those advocating anything contrary to what our constitution says should bow down their heads in shame. There is no ambiguity in the constitutional provision directing how the EC's chairman and the other commissioners are to be appointed. At no time in the past did we hear anyone stating anything contrary to what the constitution states.
One day someone apart from President Mahama will become President and I can bet my last bottom cedi that, these calls will cease.
Democracy does not mean one thing when the other party is in power and another when our party is in power.
Let's respect the constitution and there will be peace.

Article 70 (2) of the 1992 constitution states that “the President shall, acting on the advice of his errand boys {Council of State[, appoint the Chairman, Deputy Chairmen and other members of the Electoral Commission”, Those who wrote the constitution were sick and very stupid because how effectively can this council of state appointed by the president himself be bold to advise the president without fear or favour to appoint someone competent, neutral and well versed with electoral laws with no affliction to any political party to be a EC boss, The chances of this happening is zero, The council of state members should have been appointed by independent bodies such as Ghana Bar Association,Christian Council,Muslim Council,National house of chiefs, etc ,StUdent Association,Trade Union etc to serve Ghana These independent bodies should have elected members to the council of state who should have in turn select the EC Boss after a very wide consultation and opening an application process.
As the constitution stands now,Mahama would be very stupid not to appoint anyone who would help him rig the elections.
This aspect of the constitution needs to be rewritten as soon as possible. The constitution must also force EC boss to listen and implement advice and recommendations that comes up after inter party advisory meetings.Until this is done,Elections in Ghana would be far from being fair and credible

Do not make noise about the Ghana constitution, dictated to suit self interest.A president appointing an electoral commissioner. In a true democracy to ensure fairness ,this is never done. This position is subjected to parliament with two thirds majority vote and not the president.Stop refering to a dictated military ruler constitution.it is more than some pieces of woods. It has done more harm than good, and if not properly overhauled will lead the country into chaos.A true and honest leader will seek parliaments approval to change this dictatorship laws.

Arthur Kennedy, you are absolutely right on the interpretation and application of Article 70(2) of the 1992 Constitution. Those who are claiming the Council of State should appoint the next EC do not understand the constitution and have forgotten what has been done since the Fourth Republican Constitution came into force.

The key to free and fair elections is the needed reforms. When we have progressive, transparent, procedural arrangements governing the conduct of our general elections, not even Mahama or any other sitting President doubling as EC chairman for that matter, can influence the process enough to his advantage. So lets clamour and push for electoral reforms.

Unfortunately you misunderstand the constitution.
But first, understand that some of us are interested in this issue from the persoective of enforcing the constitution not because of fears or concerns about politics.
Second, you need to read the constitution, especially Article 70 (1). Consultation is not Advice.
Third, this Article 70(2) was copied from the 1969 Constitution. Of course, it is known that the President then was a ceremonial head and the power was effectively vested in the Council of State.
Fourth, "advice" is a term of art. It is like a medical term. What a medical term means to doctors may be different from what it means to laymen.
Finally, stop saying things like it happened under Kufuor and JJR so it must be right. That misunderstands how constitutional litigation works.
I have written enough about this that i think most people in the country now know that the Council of State must give the President a name to appoint, in his position as Head of State, as distinguished from when he appoints say a minister, which he does as both head of government and head of state.
Thank you
