It's not over yet Dr. Kwame. We are still waiting for the Supreme Court to interpret Article 70(2) of the constitution. We believe that the action taken by Mr. Mahama did not reflect the letter and spirit of the above mentioned article. But this has nothing to do with whether the lady appointed is qualified, fit to be the chairperson or not. In fact, that is a separate matter altogether.
Mr. Mahama should've waited for the Supreme Court's ruling on the matter before appointing the lady, because there was no need for him to rush. We believe that he panicked because there is a possibility that the SC might decide against their narrow and dictatorial interpretation that allows the president to appoint an EC boss and its members contrary to fair play and common sense. Those who argue against his powers to appoint the EC chairperson in the manner he did it, have valid and concrete points. Since the president is also a political player, he should not be allowed to substantively appoint the referee, and we don't believe the constitution allows such a thing.
No matter the type of cut and paste constitution we may have, we don't believe the framers intended to give undue advantage to one political player over the others. Even though we know that it was written under the P/NDC military dictatorship that wanted to control every institution to its advantage, and twisted the neck of Article 70(2) to appoint the first EC chairman in order to perpetuate their rule, it does not mean that it was right and we should not allow the undemocratic process to continue indefinitely in our democratic dispensation.

That is, NPP believe that it should be their president who should have made the appointment and not NDC’s Mahama.
In any case, after given consideration to Articles 234, 235(1) and 236, and on what Dr Gyampo said yesterday, I have concluded that Mrs Osei reassignment or appointment is unconstitutional and should not be allowed to stand unchallenged. I sent an article to Ghanaweb yesterday but it’s not yet posted. Watch out for the reasons I gave in the article tomorrow

Of course every person has the freedom to change their views on any subject matter, but not when the reasons underpinning the switch are tenous, at best.

It's unreasonable at this point to view and welcome Mrs. Charlotte Keeson-Smith Osei's appointment with politics of suspicion and cynicism. Mrs. Charlotte Osei's appointment should not terrify the NPP even if she's a one-eyed NDC supporter. What should be terrifying for NPP is the party's infighting, lack of ground operation/organisation and lack of campaign strategy.

Since the beginning of the Fourth Republic, NPP have taken very perilous positions that I wonder if they ever stop to take stock of where such actions have landed them.
1. They surrounded Parliament to NDC for 4 good years after 1992 Presidential elections. They were hoping something would happen to prevent JJ Rawlings from ruling the country as an elected President since the new constitution did not permit a one party state. Well, NDC deliberately allowed some seats to be won by others, and the one party situation was avoided and NPP had to wait for 4 good years to allow their members join the new Parliament in 1997. What a waste of time that was.
2.For the 1996 Presidential elections, NPP again sponsored an individual to petition the Supreme Court as to whether Kwame Mpiani was qualified to stand as their candidate in view of his conviction for treason. While expecting a quick answer to their riddle, the SC took such a long time to decide, that it affected the morale of the party and its subsequent primaries which had to be rushed through as soon as the SC declined jurisdiction. Kwame Mpiani was so popular among NPP that they did not have any real alternative, but were afraid to field him, lest the NDC block him with a court order. So relunctantly the primaries were held without Mpiani and Kuffour won but went on to lose to JJ. Why did NPP waste so much time on a non issue and only begun actual work after the SC threw out the petition? That is the million dollar question. Again, look at the various motions that the put before the SC in the 2012 election petition. First to prevent Justice Atuguba from presiding and then to prevent Tsikata and NDC from joining. While they needed a quick resolution of the case a la Kenya, they were also once more bogged down by their own doing. Now they have gotten another person to file a petition against the President from chosing a replacement for Afari Gyan and they are pinning their hopes on this, as if to say once the SC rules in favour of their position, that is the moral impetus they need to organize and kick start their campaign, thus sweeping all other issues aside. You know what, the SC cannot be hurried to give a ruling, and this may go beyond 2015 into 2016, with the NPP still waiting, while the new EC chairperson is working and NDC busy campaigning. Why can't NPP leave legalities aside and do some concrete campaigning that is required of an opposition party seeking to beat a strong and strategic party as the NDC? I just wonder. The NPP is always saddling itself with extra baggage.
