The ingredients of entrapment will include enticing a suspect to commit a crime that ordinarily he Was not predispose to doing same. That the entrapped person has not had any previous record of committing the same crime. So clothed with these, I think justice Derry stands a good chance of wading through. The particular case cited by you has no same legal principles per the rules of entrapment. Any way why tag him (in)justice Derry when the issues are not yet determined. It unfair

Razak Seini, I believe you are an Attorney and therefore you understand the law better. I am not a lawyer so I argue from a layman's point of view. However, you are wrong in suggesting that there was no previous record of Dery collecting bribe to free criminals in his court. The Anas team targeted him because they had information that he has been taking bribes. Indeed, that was confirmed by his intermediary, Mayor. I guess by previous record, you mean being caught red handed, charged, tried and found guilty. That is a fair point but not common sense to me.
I have no apology for referring to him as Injustice Dery. He is a criminal and does not deserve to be referred to as Justice. Until Ghanaians called a spade, a spade and not an instrument for collecting sand as well as stopped the ostrich attitude, this canker of corruption will make Ghana a failed state. It is common knowledge that Ghanaian judges take bribes to give false judgement. How can you explain a judge who ruled that because there was no DNA to prove that the body parts found with the accused was not that of the murdered Ya-Naa and set the accused free? Is possession of human body parts not a crime in Ghana?

Which Whistle Blower Act are you talking of - the Ghanaian one or the USA/UK one?
A little bit too repetitious on the public interest issue. Seems like you're saying everything is justified as long as there is sufficient public interest.
It's one thing crying out our revulsion at the misdeeds of the justices. It's a different thing drawing out the legal implications of Amereyaw's methods. Our anger should still not blind us in certain respects...

Ata come on. More of this contructive argument that make makes some of us laymen to understand what is justice and injustice. I guess all these so called artoneys will be coming forth to defend their friends in crime. It is about time this non-sense in Ghana is stopped. Indeed let us call spade a spade and not an intrument for sand collecting otherwise Ghana will go down to the pit. That you again for coming forth bravely to defend your argument.

I am at a loss to understand my friend Razak here why Mr. Dery should not be tagged Injustice. Do you really consider a judge who would accept money and goat or what not to set a hardened criminal, and for that matter armed robber free as doing justice to the Ghanaian public?? Have you ever been visited by any armed robber between the hours of 0200 hours and 0300 hours with pistol fully loaded pointed to you head and demanding either your life or your hard earned money?? It is wicked to set these people free to go back to take people's life instead of putting them behind bars for life. Think about it.

A Russian Mafia boss and human rights activist were caught having sex in his jail cell after prison bosses set up secret cameras.
The crime lord and blonde woman were captured in the act as she visited him to check he was being treated well in prison.
Prison bosses set up the video equipment after becoming suspicious when their meetings began taking longer than necessary.

Razak, if I get him right, is pointing out some legal issues. That is what you should discuss.
The law is not an upholder of morality. That is why proven murderers (like O J Simpson) can walk free even though the judge did not get a bribe. Kofi Ata is arguing on the legality of the issue, even if he protests that he is not a lawyer.

MASSA KOFI, Justice Dery's injunction against Anas' expose and to prevent the video being shown to the public cannot be justified by his application. Justice Dery is simply seeking to prevent the evidence and his identity in the public domain.
Definitely, Anas' expose is legitimately in the public interest. It reveals corruption in the country's Judiciary, the misconduct of some of the country's Judges, the miscarriage and denial of justice and human rights violations and of course, the threat to our democracy.
More so, Justice Dery's argument that Anas' investigative work method is an act of 'entrapment' is sheer nonsense. Even, if Anas' intention was 'entrapment' as he secretly recorded, Justice Dery took the bribe in a wilful way on the understanding that he was unreasonably going to deliver a ruling which will turn justice on its head. This is clearly denying someone justice and demonstration of judicial/professional misconduct. It is not 'entrapment' that's in issue, it is the bribe taking. Justice Dery has breached his Judicial Code of Conduct and he should be sacked.

I'm not here to defend the indefensible but we cannot pick and choose convenient starting points and or relative comparison that fits nicely into our chest of moral indignations. Someone wrote a rebuttal to a critique I wrote to plead the case of a saintly J.J. Rawlings who should not be criticized for an era of brutality and unsolved murders on his watch. It is in the same tribal and political party fanatics or zealotry Ghanaians draw up moral equivalence. How could we show this self indignation with the rot in our justice system in a nation where NPP, the party of most of Ghana's intellectuals, could spend some US $50 million - US $100 million on Ghana@50 when there are no district or regional hospitals to revive a dying goat? Are we this clueless in Ghana as to not know more people die in Ghana of curable diseases because of the lack of well equipped hospitals/clinics in their communities relative to deaths at the hands of street criminals? And how is it that our ex-presidents, MP's and executive level civil servants live off perks that are 1000 times the retirement benefits of Ghana's civil servants after 40+ years of service?
The seeming lack of outrage or perspective on the rot with every government decision is scary not because I'm new to the era of national follies but because we have this short term memory on things that matter the most. How is a judge selling justice any different from presidents selling national lands even as government agencies lease land and accommodations for its staff? How are these judges different from the EO group earning a lifetime 3% of Ghana's oil revenue on a natural resource they do not own even if they are deserving of a finder's fee? How are the judges different from the so-called new head of GYEEDA who promoted friends wife to head the evaluation and monitoring team thereby making her eligible for a government chauffeured vehicle and an obscene salary to boot in the name of goverment clean up exercise?
Let us revisit a culture of crab-like existence we accept as a democratic Ghana where a few can steal and make it to the top while a majority languish at the bottom. There's an incentive for us all to be thieves and corrupted to get to the top of the newly minted societal structure that allows us all to worship the rich in society irrespective of the foul means they attain their riches.

Listen to the lying game of the NPP. On daily bases we hear AFAG and Occupied Ghana shouting that the Anas tape be aired. While.on the other side, we hear its other mouth pieces, I mean, GBA, The Church, Minority spoke person, the Asantehene who thought the EC must change voters' register because it was accused by the show of NPP cooked evidences, pleading with the Chief Justice(CJ) that the hard core evidence of corruption against the judiciary by Anas must be handled with care. You see my friends, This is how best the NPP and its apparatchiks wish to direct the behaviour of Ghanaians. We are not fools or blind. I BELIEVE THIS IS A CAREFULLY PLANNED advice from the CJ's office to these separate groupings so that the CJ can create a loophole for the abortion of justice in the name of listening to the advice of well meaning citizens. Were we not in this country when a whole drama and money was thrown into a so call reconciliation, With even an ex- president, JJ dragged before it?
