Where I disagree with you is your implication that the owners were railroaded, they were not, they pleaded guilty as charged so there was no need for a trial. If the owners thought they had done nothing wrong, they should have pleaded not guilty and defended themselves. Don't forget these owners had competent lawyers who after looking at the facts and the law of the case advised their clients to plead guilty.

The behaviour of the SC is very troubling for a young democracy like Ghana, though I also appreciate that what those guys said were despicable.

What is the noise making, and the so called 'Revenge' and 'harsher punishment'! Where is the element of revenge, and how does one measure 'harsher sentence', especially in this case where death threats and 'rape' were cited? How harsh is 4-months and GH3000 to these Muntie trio who are beneficiaries of the greatest loot in Ghana's history? Give us a break! Again on the issue of the owners I see nothing wrong with joining them in the contempt suit. The host, Salifu Maase, could have avoid the situation by issuing a disclaimer as soon as those threats were made. That could have dissociate the directors and host himself from the quagmire they found themselves in. But he encourage them to fire more threats. Well no twist and turns; the quoting of huhudious terminologies, and the legal gymnastics can confuse some of us. The Justices have spoken, and some of us are happy that some bad guy are going to smell their own poop for 4-month. And above all, some sanity will be instilled in the airwave communication.

On the surface, it seems not fair for the SC to be the Police, Prosecutor and Judge in a case they are involved in but what we have failed to answer is this:, Does the constitution allows them to do what they did?

I don't even think the SC was comfortable adjudicating on this case but when the Attorney General who should have proferred charges against these people decided not to do so because of politics, then the SC resorted to their last option.

It is not like we have not seen this before. This party in power grandfather, P/NDC did this before in 1982 when three Judges were abducted and killed like chickens and these morons threatened to do it again and this time even threatened to rape the Chief Justice who is almost 70 years old. These people are sick and they deserve more than the four months they were given.

Why do counsel engaged to defend their clients, only appear before the Courts, in this case the Supreme Court, and plead guilty and thus legitimize the subsequent sentencing of their clients? They should bow their heads in shame !!!

The Montie 3 deserve not much sympathy for their despicable utterances. Having stated that, even murderers are given their fair day in court.

I heard your friend, Prof Asare on Asempafm the other day and was impressed with his view on the subject. If, as a country, we give too much power to any branch of our government, we will live to suffer the consequences one day, and we would have only ourselves to blame.

The court room is not a place for vengeance, it is, and must always be, a place to seek justice, and justice must not only be done but must also be seen to be done.

Perhaps the lawyers thought their first duty was to their clients and getting them a lenient sentence would achieve that purpose,sadly it backfired and so must be held responsible for the botch.

The only time that a judge can hold a person in contempt and administer instant justice is when the contemnous act occurred under the court's own eye and within its own hearing and therefore will not require a third parties testimony.But what about indirect contempt.

Indirect contempt of court is the violation of a court order outside the immediate presence of the court. A charge of Criminal Indirect Contempt of Court is a criminal charge. Defendants charged in this manner are afforded all the usual privileges of other criminal defendants, like the right to a trial by jury, to examine, and to call, witnesses, and to testify on one's own behalf.

The supreme court as the custodian of the right of the citizen must know what is natural justice and the rules against bias.A fair trial can not be devoid of the right of appeal and unless the lawyers stand up to the judges and challenge some of their rulings we will end up with the dictatorship of the sc.

The statements by Alistair and Ako Gunn were in reaction to what the Chief Justice said to Mrs Charlotte Osei, that they (S/C) will not sit down to see the EC plunge this country into chaos. The youngmen of Montie 3 in reaction rather opined that it was the statement of the Chief Justice that would plunge the country into chaos, and that the Justices were pandering to the wishes and aspirations of the Opposition, and that if war broke out in this country..............then some of the irresponsible and unfortunate statements followed. My case is that the three legal principles that must be met to prove corporate criminal liability were not met and therefore the SC was wrong in convicting them.

The judges acted like how a military dictator would line up people and shoot them to death. The judgement is full of vengeance. We all saw that the lawyers of the contemnors were unable to assist their clients because there was no rules and regulations of how contempt cases should be handled. All the lawyers involved in this contempt case only prostrated before the judges and begged for mercy.
We remember when Lawyer Attah Akyea tried to argue the case for his client, Ken Kuranchie in SC he was slapped with a heavier sentence than Sir John whose lawyer prostrated on the floor of the SC. You challenged the SC you are damned, you plead for mercy you are damned.
Let us help to reform the rules and regulations of contempt. The judges are human beings just like the military dictators.

The precedence had already been set in the case when "Sir John" was summoned for allegedly running the supreme court down.
His lawyer of high repute, Ayikoi Otoo, though used all technicalities available to defend his client, eventually ended up pleading and begging. Though, we deem that as a way of staying safe but, the dice was cast that very day for such demeanor and apologetic natyre of lawyers to follow anytime they appear before the judges.
Another, case of interest was when Ken Kuranchie was also summoned. Together with his lawyer Ata Akyea, they refused to follow the steps set by the first comtemnors and subsequently he ended up in the prison.
Our emphasis here is to stress that, the lawyers for the defendants can not be entirely blamed. Rather a new aproach must be sought to curtail this creeping culture.

There is no need for you to fear that. You don't have to pass law exams and be called to the bar before you can argue the legal aspects of a case on ghanaweb. Your own wide experience of the law and wide reading and contact with legal issues more than give you the right to make legal arguments on such a case before the public and the court of ghanaweb readers. And you have shown that by all the legal Latin terminologies you arraign here. Why chicken out?

In trying to argue that the SC was its own prosecutor and judge, you termed the judgement a victors' justice and compared it to the Nuremberg trials, Rwanda and Erdogan's antics. I think you may have over-done the comparison. A victor's justice must, necessarily, be one that is administered by the party that emerges victorious from a previous tussle. Such is not the case here.

If you had wanted to really make a non-legal argument, your example may have been taken from Hannah Arendt's examination of the Eichmann trial in Jerusalem in 1962. The strength of her argument was not based on the legal issues involved but the general philosophical issues of a show trial that still left out the revealing of the banality of evil. It was not a strictly legal argument.

Anyway, I think you wanted to say "Judges should be respected NOT feared". It came out as "Judges should be respected and feared" - last sentence in the fourth to last paragraph. Huh?

Why should anybody fear judges? Except in Ghana where we give UNDUE respect to people in authority - even those using their authority to screw us.

My argument was purely on Corporate (criminal) Liability. I appreciate your concern for the comparison with the 2nd World War trials but to be honest it's similar on a smaller scale. The public appetite for punishing the contemnors and the Justices determination to punish them, etc.

Aku, if you are implying that the four months prison sentence was too much, I respectfully disagree with you.

First, people are saying the three apologized and therefore deserve no custodial punishment. The fact is that only Nelson 'tepidly' apologized. Gunn even denied that he was not on that program and Mugabe even tried to justify his comments by playing the tanii tribal card.

These people could have been sent to prison for three years and got only four months slap on the wrist.

These fools threatened to rape the Chief Justice who is almost 70 years old. They threatened to murder them. They should have got at least twelve months in prison. There is nothing 'revengeous' about their punishment.

I belong to the school of thought that believes punishment should be correctional and not destructive. A perfect example of the correctional punishment is what was done with the contempt cases during the election petition hearing. The sentences at that time were clearly correctional. This one goes way beyond the desire to correct and borders on destruction. Taking a leaf from our traditional set up, our elders will, most of the time, go for the correctional and not the destructive, no matter the offense.

I am really surprised that some of us are happy with this kind of judgement. Our coutry is so divided within the judiciary, chieftancy, the clergy, and in all departments of our lives. I get scared day in and day out. I would not be surprised if one day, some stupid guys come in to disturb all of us of our peace. NDC and NPP and those who have taken political positions must know that the rat wholes will be too small for their big bellies that day. I am scared.
