The most important arm of government and in fact what defines democratic governance is the rule of law,vis a vis the judiciary.Unfortunately the courts in Ghana have always played to the dictates of affluent and influential.What that means is that justice is often circumvented in the interest of the rich and powerful.Ghana's court per the attitude of some extremely corrupt lawyers ,judges inclusive have never been representative of the ordinary citizenry.Unfortunately,they are always the victims of oppression and brutalities by people who wilt power,have the political links and the cash to influence judgment in their favour.There are multitudes as victims of grave injustice whose cases are never heard in court,suppressed until it is rendered redundant.Many have died out of sheer frustration because our high courts have connived with offenders to cover cases up some of which are criminal in nature.This is particularly true in cases involving state or public institutions where the AG connive with the high courts to gag up cases to avoid judgement debt liabilities and protect high profile corrupt public officials.There are so many of such cases in the high courts including the human rights court thwarted with the help of lawyers who collude with judges and in most instances the AG and state institutions of law like the police to ensure these cases are never heard not to talk of reaching the public domain.The murder of the young soldier as former President Rawlings put it is because of injustice.People have been mamed,killed,unlawfully dismissed from work or have their properties seized through arm twisting only for the court to let them down in the interest of powerful persons as perpetrators of such heinous crimes.Ghana's high court is riddled with so much corruption that you always have a hurdle to cross right from a hired lawyer,through court clerks to judges.I am for the school of thought of limiting restrictions in the law school to deal with the problem of monopoly and torture of poor clients who struggle to pay legal fees only to be let down by some very corrupt lawyers only interested in the highest bidder.One very common practice observed among lawyers which is the most callous and unprofessional thing to do is to connive to destroy a client's case when paid off by an opponent.A subtle approach of slowly dragging cases over years in so-called 'legal gymnastics' will certainly frustrate the litigant to give up with some in fact dying in the process never to obtain justice.Some of us have no doubt in the competence and ability of the new chief justice.But what is she going to do to rid the justice system of corruption and all manner of illigalities known to many way before Anas' expose'?The major task of the judiciary is to ensure justice in the interest of poor and defenseless citizens,not the powerful and rich often the villains with the capability to manipulate the justice system.That is what defines rule of law and democracy.If this simple task can be carried out the judiciary will certainly take its seat as the most important arm of government.
