Freeman was caught red handed when he confirmed to under cover operational team in Ghana when his number was given to them thinking that he was speaking to OPK from Alen's campaign team.

However, on two consecutive adjournment dates -July 11 and 16 Kofi failed to attend court. The nation's justice system is poking social justice's hot airs through the old-soldier-turned-banker 'torn anus', and people believe Kofi may soon suffer bubonic legal hernia. The Homeland chanced upon the former Ghana Army Captain, who once worked at the Force's pay office, but now owns 30 banks enfranchising the UT-Holding and still counting in the dock of Circuit Court 'One' at the premises of the famous Cocoa Affairs cluster of courts in Accra Wednesday, July 2, 2014. during the year 2007 at Accra in the Captain P. K. Amoabeng, who transformed his UT Financial Services into a full-blown bank —The UT Bank - for real and smart people, needs to be smarter himself, indeed, arrived in the Courtroom in a navy-blue faint-white-striped suit, bespectacled, and in lead of a coterie of bevy of three beautiful young female lawyers. The UT Bank's CEO was charged with Fraud along with his lawyer-friend, John Aidoo, Esq. formerly of State Housing Corporation (SHC), in Accra. The criminal Charge Sheet, as chanced upon by The Homeland indicts Prince K. Amoabeng and Lawyer John Aidoo for fraudulent dealing criminal charges and abetment of same, respectively; in the issue of estate of one Naa Otua Swayne; a Complainant in the case. Prosecuting, a Deputy Superintendent of Police (DSP) Dery told the Court presided over by His Honour (Judge) Francis Obiri that, 'between 2005 and 2007, in Accra in the Greater Accra Circuit and within the jurisdiction of the this court, with intent to defraud secretly and with deceit, (Prince Kofi Amoabeng) did release the Title Documents of property No.; 23 Ringway Estate owned by Naa Otuah Swayne, which were in Kofi's custody to (the • late) Alexander Adjei, to use as a Mortgage to secure a loan of GHc1,279,000 from the Home Finance Company (HFC) Bank. This, the Prosecution states was contrary to Section 143 of Act 29/60 of Ghana's Criminal Code. In the case of Kofi Amoabeng's accomplice, John Aidoo, Esq., the Prosecution told the court that,
Greater Accra circuit and within the jurisdictions of the court, with intent to commit crime (Lawyer John Aidoo) did aid and abet Prince Kofi Amoabeng to commit crime to wit, fraud involving Title Documents of property No.; 23, Ringway Estate belonging Naa Otuah Swayne: It spells out the act of Fraud as to thing pledged or taken in execution, as contrary to Section 20 and 143 of Act 29/60 of Ghana's criminal code. Both accused, however, pleaded not guilty to the criminal charges of perpetration of fraud and aiding and abetting of same as presented by the prosecution. The prosecution called five witnesses in support of their case. No Case And indeed, after the close of prosecution's case, however, the accused persons' Al — Prince Kofi Amoabeng and A2 - John Aidoo's counsel filed a submission of 'No Case' to answer. In his ruling on the submission of 'no case', the presiding judge re-examined and identifies the offences preferred against the accused persons On count one, Prince Kofi Amoabeng (A'1') has been charged with Fraud as to things pledged or taken in execution contrary to section 143 of Act 29, which provides as follows: 143 — A person who secretly or by duress or deceit and with intent to defraud, takes or obtains property from a person to whom that person has pawned, pledged or otherwise bailed it, or from a person having, by virtue of an execution, seizure, or any other process of law, the possession, custody or control of

the property commits misdemeanor. It is therefore imperative to state that, under section 143 of Act 29, the prosecution must prove the following against Kofi Amoabeng: That the victim Naa Otuah Swayne pledged, pawned or backed his property in the care of the accused; (b) that this property belongs to the victim by virtue of seizure, execution or any other process of law; (c) that the property was in the custody or control of the accused; (d) that the accused took this property secretly or by duress or deceit and, (e) the intention of taking it without the consent of the victim was with the intent to defraud. That is with intent that, it will be parted away from the victim without her consent. In respect of count two - John Aidoo, Esq (A2), the presiding judge examined his charge of abetment of a criminal offence contrary to section 20(1) of Act 29 and explains its provisions as follows: 20(1) A person who directly or indirectly instigates, commands, counsels, procures, solicits or in any other manner purposely aids, facilitates, encourages, or promotes whether by personal act or presence or otherwise, and a person who does an act for the purposes of aiding, facilitating, encouraging, or promoting the commission of a criminal offence by any other person, whether known or unknown, certain or uncertain, commits the criminal offence and or abetting the other person in respect of that criminal offence. The judge explains that it is for the prosecution to prove the following ingredients against the second

accused person: (a) that the accused acted directly or indirectly; (b) that the act amounted to instigating, commanding, counseling, procuring, soliciting or; (c) that the accused acted purposely to aid, facilitate, encourage or promote the commission of a crime by another. After considering all these, in view of the prosecution case before him; fortifying his stance with section 173 of the criminal and other offences (Procedure) Act 1960 (Act 30), the court was convinced that the accused persons have cases to answer. The fear of this, however, prompted Prince Kofi Amoabeng to quickly file a Stay of Proceeding at the criminal court to seek refuge at the Human Rights court. ...And Lawyer John Aidoo, when as the Solicitor-Secretary at the State Housing Company (SHC) aided, without recourse to due diligence, whether by fair or foul intention, to change the status of house No.; 23 Ringway Estate in Accra, with a document prepared and signed on behalf of Naa Otuah Swayne, by Cpt. Prince Kofi Amoabeng (rtd) without the victim's consent; ceding the property to one Alexander Adjei, who is now late. Meanwhile, when the Human Rights Court in Accra invites the arguments from lawyers of both fraud victim — Naa Otuah Swayne and Human Rights victim- Prince Kofi Amoabeng before or on 28th July, 2014 to be able to fix a date for ruling on whether Prince K. Amoabeng's rights had been trampled upon by the lower court's requests for him to open defence, Kofi and his co-accused John Aidoo were to reappear before the Circuit court on 30' July, 2014.
