Lawyer for the third accused in the Kwabena Adu-Boahene case, Elikplim Agbemava, has welcomed the Accra High Court’s decision to discharge his client.

This follows the decision by the Attorney General and Minister for Justice, Dr Dominic Akuritinga Ayine, to discontinue the prosecution of Mildred Donkor in the ongoing GH¢49 million theft case involving former National Signals Bureau boss, Kwabena Adu-Boahene, and his wife, Angela Adjei-Boateng.

Additionally, the court has further directed that all records of hers be expunged from the records.

Speaking to the media on Friday, October 17, 2025, Mildred’s lawyer indicated that the court’s decision shows his client was not involved in any wrongdoing related to the case.

“Generally, upon receiving the brief, I always believed that there was a total lack of mens rea, [the intention to commit a crime]. What has happened is really in line with our thinking, and we will go back home and take it all in and see what we do next,” he said.

He added, “It doesn't [affect anything] because there are also other charges relating to the crime of stealing and if you see, my client was not mentioned as being part of the crime of stealing. Her name only appears in count 10 and 11. It's pretty clear that in terms of the formation of whatever has gone wrong, she was not part of that conclave to decide on anything.”

Meanwhile, according to a notice filed at the High Court in Accra on Wednesday, October 15, 2025, Donkor was formally discharged under Section 59 of the Criminal and Other Offences (Procedure) Act, 1960 (Act 30).

The decision follows her reported agreement to serve as a prosecution witness in the case.
