Lawyers representing Dr. Cassiel Ato Forson have submitted a supplementary affidavit supporting their motion for a mistrial, injunction, and/or stay of proceedings in the ongoing ambulance case.
The affidavit includes a trending recording of a phone conversation between Richard Jakpa (the third accused) and Attorney General Godfred Dame, containing evidence of criminal and prosecutorial misconduct by the AG.
Additionally, quotes from media reports, notably Asaase Radio, highlighting professional misconduct by the AG, have been cited and attached to the affidavit.
Ato Forson is requesting the court to declare a mistrial in the interest of justice, emphasizing that justice must not only be done, but must also be manifestly seen to be done.
He asserts that the Attorney General has engaged in reprehensible and unlawful behavior solely to secure his conviction.
Ato Forson argues that if the court proceeds with the trial despite these serious allegations of misconduct, it would constitute a travesty of justice and undermine public confidence in the legal system.
The application is scheduled to be moved on Tuesday, June 4, 2024.
