Senior pastors of the pastoral council of the Christian Divine Church, have sued the chairman of the church, Apostle Ebenezer Boahen, the vice chairman, Augustine Agyeman, and the acting general secretary, Pastor Samuel Awuah. They seek a court order to restrain them from holding the church’s 65th anniversary celebration scheduled for May 24-26, 2024, at the church’s headquarters in Tarkwa because thier term of office has expired 3 years ago and still holding on to the seat.
According to the plaintiffs, the current interim administrative committee of the Christian Divine Church does not have the mandate under the church’s 2005 constitution to hold any meeting with the intention of forming the general council, the working committee, the executive council, or any other committee of the church.
In court on Wednesday, counsel for the plaintiffs, Lawyer George Abbottah, requested the court to grant them substituted service since all attempts by the court bailiffs to serve the three respondents have been unsuccessful. He claims this is a deliberate attempt by the respondents to avoid the court summons.
However, one Kweku Kyere from Accra who claimed to be a friend of the court, expressed interest in the case and appealed to Her Ladyship to grant him an audience. Speaking in court, he mentioned that the respondents are currently seeking spiritual intervention ahead of the program that's why they cannot be found to be served, but assured that the respondents will be available to receive the surmons.
The presiding judge, Her Ladyship Mercy Adjei Kottei, ruled as follows:
