The accused persons are facing 78 counts of corruption related offences
The high-profile SML-GRA case involving former Minister of Finance, Ken Ofori-Atta, and seven others has been adjourned following the court’s announcement that it would not sit on the originally scheduled date of Monday, November 24, 2025.
The case, officially listed as CR/0106/2026: The Republic v Kenneth Nana Yaw Ofori-Atta & seven others, was expected to see the accused persons appear before the court as part of ongoing proceedings related to the SML-GRA scandal.
A portion of the suit filed by the OSP at the Criminal Division of the High Court in Accra under case number CR/0106/2026 states:
“Conspiracy to commit the criminal offence of directly or indirectly influencing the procurement process to obtain an unfair advantage in the award of a procurement contract, contrary to Section 23(1) of the Criminal Offences Act, 1960 (Act 29), and Section 92(2)(b) of the Public Procurement Act, 2003 (Act 663).”
The OSP made the announcement in a post on its X page, as sighted by GhanaWeb, indicating that a new date will be communicated.
In the post, the OSP stated: “It is the court that sets a date and not the OSP. When they say they can’t sit, you have to wait for another date.”
On November 18, 2025, the OSP filed charges related to violations of Section 23(1) of the Criminal Offences Act, 1960 (Act 29), and Section 92(2)(b) of the Public Procurement Act, 2003 (Act 663).
SML-GRA Scandal: OSP to arraign Ofori-Atta, 7 others on Nov 24
Those expected to face prosecution include former GRA Commissioner-General Dr Ammishaddai Owusu-Amoah; former Deputy Commissioner-General Emmanuel Kofi Nti; senior GRA officials Isaac Crentsil and Kwadwo Damoa; Ernest Akore, former Technical Advisor at the Ministry of Finance; Evans Adusei, owner of SML; and the company itself.
Earlier in 2025, the OSP declared Ken Ofori-Atta a fugitive and called for his arrest.
