Court discharges two unemployed persons

An Accra Circuit Court on Tuesday struck out the case of conspiracy to commit crime and robbery involving Atitso Kwesi and Kwadwo Prosper, both unemployed, for want of prosecution.

Chief Superintendent of Police Tuaruka Duuti told the court presided over by Mr Francis Obiri, that prosecution was unable to get witnesses to testify in the case. He said the investigator handling the case indicated that the witnesses in the case were adamant and unwilling to testify.

The judge said the accused persons had been in prison custody for the past one year and the case has witnessed 35 adjournments, hence their discharge. The prosecution said the complainant in the case is a trader, while the accused persons are unemployed.

He said on May 27, 2013 at about 0430, the complainant was walking with a witness in the case to board a vehicle to Aflao en route to Nigeria to transact business.

Chief Superintendent of Police Tuaruka said the complainant together with the companion decided to use a short route behind a public toilet that leads to the main lorry station.

He said whilst on the way, the accused persons suddenly emerged behind a metallic container and struggled with the complainant and snatched her hand bag containing GH¢19,000 and bolted.

“On May 29 and May 31, 2013, with assistance of some Zongo youth and police patrol team, the two accused persons were arrested from their hideout and subsequently identified by the complainant as the culprits who robbed them,” he added.

A search conducted on Kwesi revealed cash sum of GH¢100 and unregistered motorbike retrieved from him. During interrogation, he stated that Prosper gave him an amount of GH¢1,000 for safe keeping and additional GH¢200 as a gift.

However, Kwesi claimed the motorbike belongs to one Ebenezer, but could not lead the police to locate him. Moreover, Prosper has been able to purchase a new kiosk within the period but refuse to tell police the cost.
