Court gives ultimatum to NDC

Ho, June 7, GNA - Mr Justice Richard Apaloo, an Appeal Court Judge, on Monday gave the leadership of the National Democratic Congress (NDC) up to Monday June 14, to create enabling conditions for Dr Kwabena Adjei, Member of Parliament (MP) for Biakoye to file his nomination to contest the Constituency Primaries.

Mr Justice Apaloo, sitting as an additional High Court Judge, said he would proceed with Dr Adjei's application for injunction on the conduct of the primaries if the Party failed to meet his offer. He issued the ultimatum when Counsel for Dr Adjei, Mr G.K. Mensah-Etsi, told the Court that the NDC had failed to move towards the settlement of the case as agreed on during the previous sitting of the Court on May 6.

The Judge pointed out that all that the plaintiff wanted was to be given fair opportunity to contest the primaries and no impediments should be put on his way.

"Give him the chance and if he loses, then he knows he was given a fair chance, that's all", Mr Justice Apaloo said.

Counsel for the NDC, Mr Saviour Dzikunu, said he was equally taken aback for lack of "movement" on the part of the NDC Leadership towards resolving the impasse as agreed on during the previous sitting of the Court.

Mr Dzikunu contended that the Party's General Secretary had been communicating with the plaintiff and expressed the hope that Dr Adjei would be given the nomination forms from where the process of settling the impasse could begin.

Mr Michael Gamor, Volta Regional Organiser of the Party, who represented the Party at the Court, said all processes towards the conduct of the primaries had been suspended and that everything depended on the National Executive.
