Court rules in favour of E.P. Church, Ghana

A Ho High Court presided over by Mr Justice Attah Asare-Korang, on Monday ordered the Ho-Fiave Branch of the Evangelical Presbyterian (E.P.), Church of Ghana, to return all movable property and title deeds covering the Fiave land and chapel to the E. P. Church, Ghana.

Justice Asare-Korang also ordered the defendants to return all church collections before July 1991, to the plaintiffs and awarded a 1.5 million cedis cost against the defendants.

The Plaintiffs represented by Mr Aggrey Gikunoo and Mr Saviour Dzikunu, both Ho based Legal Practitioners, brought the action in 1994, for the recovery of property of the church, which was taken over by the defendants following their breakaway from the mother church in 1991.

Mr Jones Dotse, leading Counsel for the defendants, told the Ghana News Agency, that the defendants have filed a notice of appeal to the court of Appeal, and also applied for a stay of execution of judgement.

He said the judgement did not address pertinent legal issues raised in the matter, and that the defendants were not sued in a representative capacity as the judgement indicated.
