Elizabeth Frances Sey JCR elections postponed until further notice

The Judicial Board of the University of Ghana Students Representative Council has, in a unanimous decision, granted an interlocutory injunction on the 2020 Elizabeth Frances Sey Hall JCR Election.

The judgment which was delivered by Her Ladyship Blessing Otchere Darko Adutwumwaa (Chief Justice of the UGSRC Judicial Board) implies that the 2020 Elizabeth Sey Hall JCR which was slated for Monday, March 9 2020 cannot come off as scheduled.

According to the March 7 judgement sighted by Univers News, the interlocutory injunction was granted on the three (3) grounds notably set out in the case of Welford Quarcoe v. The Attorney General.

Here is an except of the March 7 injunction pending appeal judgement:

“After hearing the Applicant / Applicant in this motion ex-parte for interlocutory injunction and after a thorough perusal of the action before us, this board has decided on the matter at hand on three (3) grounds notably set out in the case of Welford Quarcoe v. The Attorney General to ascertain the grant of the interlocutory injunction as follows; 1. That there is a serious case to be tried.

The board finds after perusing the case at hand that there is indeed a serious matter to be tried and as such satisfies itself on the first ground.

2. That the balance of convenience is tilted not to inconvenience any of the parties in the substantive matter. The board again satisfied itself that, the grant of this interlocutory injunction will not inconvenience any of the parties harshly but rather if this application is not granted, will woefully affect the Applicant / Applicant herein.

3. That the irreparable damage will be caused to the Applicant / Applicant herein if the application is not granted. The board again was convinced that the refusal of the application before it will seriously affect the Applicant / Applicant as to no amount of compensation can cover or make up for it.

That the absence of any of the above three would have caused the application to fail, but on the contrary, the board was satisfied as to the establishment of all three grounds and as such grant the application for Injunction on the Electoral Process of the Elizabeth Frances Sey Hall JCR Elections. Same is ordered accordingly.”

The appeal case is scheduled to he heard on Monday, March 9 2020 at about 7pm.

The appeal case was brought to the SRC Judicial Board by the solicitors of Mr. Wisdom Ndukwe, an aspirant in the 2020 Sey JCR Elections.
