The Chairman of the Constitutional and Legal Committee of the New Patriotic Party, Frank Davies; and the National Communications Officer of the National Democratic Congress, Sammy Gyamfi, engaged in a heated exchange that culminated in a warning being issued to Sammy Gyamfi on live TV.
Both lawyers appeared on Accra-based JoyNews' 'Newsfile' program to discuss a recent audio recording believed to contain the voices of the Attorney-General and Minister for Justice, Godfred Dame; and businessman (third accused), Richard Jakpa, in the ongoing ambulance case trial.
Sammy Gyamfi, in his submission, stated that he could not comprehend why an Attorney-General of such high profile would allow a person fabricate a lie in order to have someone imprisoned.
“... and prosecute to forge a medical excuse duty. Plea bargaining includes telling a witness who by law is supposed to testify to matters he perceived, matters he knows to be true; persuading him to testify to matters that you think that you as an adversary think to be the truth. Is that plea bargaining?”
He continued: “You see there’s been lot of talks about oh, let’s talk in line with our training as lawyers but what is actually being done on this platform is that the law and training we’ve been given as lawyers is being turned upside down.
"This is the apogee of intellectual dishonesty... the things on the table, what has it got to do with plea bargaining or we don’t know what the plea-bargaining law actually talks about?” Sammy Gyamfi quizzed.
However, in objection and a swift rebuttal to Sammy Gyamfi's assertions, Frank Davies dismissed the claims, asking Sammy Gyamfi to retract, saying “I didn’t state anything against your objection. Please, I have showed you so much respect. Sammy, I have showed you so much respect and I don’t intend that you come here with an attitude to disrespect me because I have never disrespected you.
“... You said I made comments against your person. I never and have never made comments against your person, please.
“You see, if Sammy Gyamfi is making a point, we are three discussing; myself and him and Kweku Painstil. I have never throughout the discussion said anything about plea bargaining so if he’s talking in the context of plea bargaining, he should situate it to Kweku Painstil. He should not use particular words to describe all of us,” the angered Frank Davies said.
