GGAGG petitions Special Prosecutor over PDS brouhaha

The Good Governance Advocacy Group Ghana (GGAGG) has petitioned Office of the Special Prosecutor to investigate circumstances leading to the suspension of the Power Distribution Services (PDS) concession agreement.

PDS – a local and foreign consortium – in March 2019 took over power distribution functions of the Electricity Company of Ghana (ECG) under a concession deal that would allow it to operate ECG facilities for power distribution for the next 20 years.

However, four months into the agreement, Ghana government last week suddenly applied brake on the concession agreement, suspending the entire transaction for what it called “detection of fundamental and material breaches of PDS’s obligation in the provision of Payment Securities (Demand Guarantees) for the transaction which has been discovered upon further due diligence.”

Although government says it has formally commenced a full-scale inquiry into the detected breaches on the PDS contract, GGAGG is requesting that the Special Prosecutor investigates “the deal in its entirety and help expose all the perpetrators of this grand scheme against the State and the people of Ghana to help the very suspicious Ghanaians who are becoming alarmed by the whole transaction get understanding to real issues leading to these happenings.”

The group is accusing:

I. Government of Ghana for sheer negligence to duty especially the Executive i.e. (Office of the President) and Legislative (Parliament of Ghana) arms of government whose responsibility was to make sure they put proper supervision mechanism in place to oversee the smooth and proper transaction without any blemish.

II. Millennium Development Authority (MiDA) for allowing itself to be used for a fraudulent activity against the State.

III. The H.E. Nana Addo Dankwa Akufo Addo, President of the republic of Ghana, whose appointees formed this Syndicate to transact this dubious deal of NEPOTISM, CRONYISM and FAVOURITISM.

IV. Hon. Kenneth Ofori-Atta, Minister of superintending over CORRUPTION, NEPOTISM, CRONYISM and FAVOURITISM and also USURPATION OF POWER of the ENERGY MINISTRY who has sectoral oversight over Electricity Company of Ghana (ECG) as his (Hon. Ken’s) Ministry played a leading role in the signing of the agreement with him (Hon. Ken’s) as sector minister being the one who appended his signature to finalize the deal.

V. Hon. Gloria Afua Akuffo, Attorney General and Minister for Justice for Neglect of duty as government’s chief legal advisor who should have advised on the transaction to follow the legal process.
