Ken Kuranchie’s suit challenging constitutionality of OSP dismissed

The Supreme Court dismissed a suit filed by Kenneth Kwabena Agyei Kuranchie, Editor-in-Chief of the Daily Searchlight Newspaper, contesting the legitimacy of the Office of the Special Prosecutor (OSP).

The journalist dragged the Attorney-General (A-G) and the OSP to the Supreme Court, seeking a ruling to declare the OSP unconstitutional.

He prayed the apex court to declare the Special Prosecutor Act, 2017 (ACT 957) as being in violation of several articles of the 1992 Constitution.

The law was enacted to give the OSP the authority to investigate specific charges or suspicions of corruption and corruption-related offences involving public officials, politically exposed individuals, and private sector employees.

In 2023, Kuranchie filed a similar case against the OSP, which he later discontinued a few months ago before filing the new case.

The OSP received a hearing notice last week regarding the case for which Kuranchie had filed a notice of discontinuance.

Following deliberations on the notice of discontinuance, the Supreme Court dismissed the initial case, underlining that the OSP should not be burdened with such cases and should instead focus on its responsibilities. The new case by the journalist has therefore become irrelevant following the Court’s decision.
