'Ken Ofori-Atta has not been served with any court summons' - Lawyer claims

Legal counsel for embattled former Finance Minister Ken Ofori-Atta, Frank Davies, has said that his client has not yet been served with any court summons.

This comes after the Office of the Special Prosecutor (OSP) announced a court date for the high-profile corruption case involving eight individuals.

Speaking on the matter in an interview with Accra-based Joy FM on November 20, 2025, Davies reiterated that his client remains committed to fulfilling his civic obligations.

“He has served this country before. If he is notified, he knows what to do under my guidance. But as we speak, he has not been served,” Davies said.

Ken Ofori-Atta, who is currently in the United States of America, was charged by the OSP on November 18, 2025, alongside seven associates, facing 78 counts of corruption and corruption-related offences.

However, his lawyer insisted that the former minister has not received any formal communication requiring him to appear before the High Court.

The OSP announced on Tuesday [November 18, 2025] that the accused in Republic v. Kenneth Ofori-Atta & 7 Others are expected to appear before the High Court on Monday, November 24, 2025. The office also stated that measures are being taken to serve individuals outside Ghana’s jurisdiction, including Ken Ofori-Atta.

Davies, however, dismissed claims that proper service had been effected, questioning the validity of the notification process.

“There is no way my client has been notified of this court date. It is a criminal process, and service must be effected properly on him and on everyone involved. So far, nothing of the sort has happened,” he said.

He emphasised that Ken Ofori-Atta is not avoiding prosecution, describing the former minister as “a responsible citizen who understands the law and will comply if officially served.”

Meanwhile, the OSP has warned that the former finance minister could be tried in absentia if he fails to return to Ghana.

The accused persons charged are:

• Ken Nana Yaw Ofori-Atta, former Minister for Finance

• Ernest Darko Akore, former Chef de Cabinet, Ministry of Finance

• Emmanuel Kofi Nti, former GRA Commissioner-General

• Rev. Ammishaddai Owusu-Amoah, former GRA Commissioner-General

• Isaac Crentsil, former Commissioner of Customs and SML General Manager

• Kwadwo Damoah, former Commissioner of Customs and MP for Jaman South

• Evans Adusei

• Strategic Mobilisation Limited (SML)

The charges stem from the conclusion of investigations into alleged corruption and financial irregularities linked to contracts between the Ghana Revenue Authority (GRA) and Strategic Mobilisation Ghana Limited (SML).

Addressing a press briefing in Accra on Thursday, October 30, 2025, Special Prosecutor Kissi Agyebeng announced that investigators had uncovered evidence of corruption, abuse of office, and breaches of procurement laws by senior officials of the Ministry of Finance, the GRA, and individuals connected to SML.
