Martin Amidu would have retrieved Woyome cash - Ayikoi Otoo

Nii Ayikoi Otoo has stated that if Martin Amidu had not been fired as AG, the GHC 51 million judgment debt paid to businessman Alfred Woyome would have been easily retrieved.

“I believe that if Martin Amidu were in position, we will not be having these difficulties because he himself was removed for all the fight he tried to put up in retrieving these monies for Ghana.”

He also noted that the current AG, Marietta Brew Appiah-Oppong has questions to answer to Ghanaians and the Court concerning the representation of her chamber, Lithur Brew & Co, to Austro-Invest in Court although the company had been liquidated.

Mr. Amidu has dragged to the Supreme Court, Mr. Woyome, Waterville Holdings, Austro-Invest and former AG, Benjamin Kunbuor, seeking to retrieve monies allegedly paid in a fraudulent manner to the businessman.

Mr. Amidu during the court hearing on Wednesday revealed that the current AG, Marietta Brew Appiah-Oppong prior to her appointment, her Law firm, Lithur Brew & Co, was the counsel for Austro-Invest which had been liquidated in Switzerland as at July 2011 although the company had filed a suit in a court in Ghana in November 2011.

The Supreme Court has therefore struck out Austro- Invest as a respondent in the case and also ordered the Attorney General to take steps to ensure the managers of Austro-Invest do not go unpunished for their conduct.

Speaking on the Citi FM on Thursday, Lawyer Ayikoi Otoo mentioned that the current AG should have conducted further investigation into the existence of her client, Austro-Invest, before representing the company in court.

“You have to acquire the Locus Standi before you go to court and if you are going to court as an artificial person like a company, then you have to ensure that your company is in existence; then you will sue in that company’s name. So if at the time you suit, the company itself had been liquidated, what were you yourself doing?” he asked.

According to him, “these are quiet serious matters because you ought to have checked these things before going and that is why Martin Amidu is worried.”
