Otiko job suit: We’ll return to court - plaintiff

Ghana’s Supreme Court (SC) has described as incompetent, a writ filed by Ashaiman and Juaboso MP’s, Ernest Norgbey and Kwabena Mintah Akandoh respectively.

The two legislators were praying the highest court of the land to nullify the appointment of Ms Otiko Afisa Djaba as Minister of Gender, Children and Social Protection on the basis that she did not do the legally required one-year national service after her tertiary education.

The apex court of the land, dismissed the case on Monday, December 12, on the basis that lawyer for the two NDC MPs, Godwin Edudzi Tamakloe, had no valid license from the Solicitor General to qualify him to practice as a lawyer as of the time he filed the writ on behalf of his clients.

But reacting to the ruling, Ashaiman MP, Ernest Norgbey who appeared unperturbed said they will keep faith with lawyer Edudzi Tamakloe and file another writ in court.

“Definitely, we have to file again. So we will see our lawyer and see what we have to do,” he told Class FM.

He continued: “It has not been thrown out, it has been struck out and when you strike out a case it is different from dismissing the case. There were some technicalities that were brought before the judges to consider and we all understand the situation.

“They didn’t look at the merit but only the technicalities but we have to go back study it and bounce back because it is not about Otiko, it is not about government or anybody but putting the right principles in place. If you don’t do national service you don’t deserve any employment in any public or private institution. We need to put this in context so that at the end of the day those who did not do national service will know their fate in the future”.
