Prosecution closes case in Ekow Micah's trial

The prosecution in the case of Ekow Micah, the ace musician who is being held over a drug-related charge, closed its case on Thursday after calling three witnesses.

Addressing the Circuit Court, Assistant Commissioner of Police (ACP) Moses Atibillah, citing section 173 of Act 30, prayed the court to take a look at whether or not a prima facie case had been made against the accused person.

The court presided over by Mr Aboagye Tandoh noted that the court would have to analyze issues before taking a decision on the matter.

It, however, intimated that it would listen to an application for leave filed by the defence counsel, Mr Andrew Vortia, to recall a witness.

The court, therefore, adjourned the matter to Tuesday, October 20.

Continuing with her cross-examination, Deputy Superintendent of Police (DSP) Mercy Agyapong, a laboratory analyst, said he saw the name of an independent witness on a sealed brown envelope containing the drugs.

She disagreed with counsel that she did not use the correct method to analyze the drugs found in Micah’s house.

According to the witness, she took one milligramme out of the 127 grammes of the drugs for testing.

Micah has denied the charge of possessing narcotic drugs without lawful authority, and he is currently on remand.

Narrating the facts of the case earlier, ACP Atibillah said Micah is a resident of Ogbojo, near Kokrobite in Accra.

He said, on August 4 Micah was arrested by the Airport Police over an alleged extortion case currently under investigation.

ACP Atibillah said the following day, at about 1130 hours, the police and the accused person visited Micah’s house to conduct a search and in the process, a quantity of dried leaves suspected to be Indian hemp was found concealed in Micah’s “back pack”.

The prosecution said the exhibit was sent to the Police Forensic Crime Laboratory for examination.
