As discussions continue on the decision by the Attorney General and Minister of Justice, Dominic Ayine, to discontinue the case against former Minister of Works and Housing, Collins Dauda, documents containing the charge sheet filed at the court by the former Attorney General, Godfred Dame, have surfaced.

The 33-page document captures the charges leveled against Collins Dauda and four others for their role in the Saglemi Housing scandal.

Alhaji Collins Dauda, alongside Andrew Clocanas (now deceased), former Executive Chairman of Construtora OAS Ghana Limited, Alhaji Ziblim Yakubu, former Chief Director of the Ministry of Water Resources, Works and Housing, Kweku Agyeman-Mensah, former Minister for Water Resources, Works and Housing, and Nouvi Tetteh Angelo, CEO of Ridge Management Solutions Ghana Limited, were slapped with seventy (70) counts of causing financial loss to the state.

Justifying his decision to discontinue the case, Dominic Ayine said that part of the amount was used to construct houses at Saglemi, making the charges flawed.

“In other words, the value of that built environment is, in my considered opinion, a key determinant of how much of the total sum was allegedly misapplied by the Honorable Collins Dauda. Discounting the value of the built environment renders those charges, in my considered opinion, defective,” he stated.

He also noted that subsequent payments made by other ministers after Dauda left office were not considered in the prosecution’s case.

“For instance, Atta Akyea, as Minister of Works and Housing, approved a payment of $5 million in 2017 that ought to have been considered in determining the value of state funds that Collins Dauda had misapplied. But that wasn’t done. And note, ladies and gentlemen of the media, that Atta Akyea was never charged, even though Collins Dauda was,” he pointed out.

Responding to the claims by Dominic Ayine in an interview with The Law Lab, the former Abuakwa South MP disagreed with the reasons given as the basis for letting Collins Dauda off the prosecution hook, saying, "It doesn't make sense."

"Why hasn't he joined me [in the case]? Now, he has a superior understanding. It was possible to amend the charges to bring me in as the fifth accused that I also made unlawful payments," the former, four-term Abuakwa South legislator argued.
