Supreme Court To Hear Tsatsu’s Motion

The Supreme Court will on Tuesday hear a motion filed by lawyers for former GNPC Chief Executive Tsatsu Tsikata for an interim injunction restraining an Accra Fast Track high Court, from continuing a case brought against him. The lawyers want the injunction placed until the Supreme Court's determination of a substantive motion challenging the constitutionality of the fast track court.

A date has not yet been fixed for the hearing of the substantive motion. Tsikata is on trial for wilfully causing financial loss to the state, by allegedly by-passing the Board of Directors of the GNPC and guaranteeing a loan of 6.9 million French francs with interest inclusive to Valley Farm, a private cocoa growing company of which GNPC held an initial share of 17.39 per cent.


The loan, totalling about 2.2 billion cedis was from the Caisse Francaise de Development, a French aid agency. When the case, which was withdrawn from the circuit tribunal was called at the fast track court last week, the former GNPC boss refused to enter a plea.

His counsels, Professor E. V. O. Dankwa and Major R. S. Agbenotor told the court they do not recognise the existence of the fast track high court and have filed a motion at the Supreme Court for an interpretation. The court adjourned proceedings to Monday after entering a plea of not guilty on behalf of the accused, to enable it study the said motion filed at the Supreme Court.
