Wulensi MP gets stay of execution

THE Court of Appeal on May 15, 2002, granted an application for a stay of execution sought by the Member of Parliament for Wulensi in the Nanumba district of the Northern Region, Mr Samuel Nyimakan, against the earlier ruling of the court nullifying his status as the MP of the area.

The court which was presided over by Mrs Justice Georgina Wood, with Mr Justice Farkye and Mr Justice Omari-Sasu as members, granted the application for a limited period of two months. The application is to enable the Supreme Court to hear and determine an appeal filed by Mr Nyimakan against the decision of the Court of Appeal which upheld the ruling of a Tamale High Court stripping Mr Nyimakan of his Parliamentary title on the strength of the fact that he did not hail from the Wulensi area.

A certified true copy of the ruling said the registrar or deputy registrar of the Court of Appeal was to ?expedite action on the preparation of the record for onward transmission to the Supreme Court and also brought to the attention of His Lordship, the Chief Justice for a very early date to be fixed for the hearing of the appeal.?
