Accra Jan 25, GNA - An Accra Fast Track Court, will on Tuesday, February 6, start hearing a suit filed against the Volta River Authority (VRA), by Dr Charles Wereko-Brobby, Former Chief Executive Officer of the Authority.
The date was fixed at its sitting on Thursday after Mr Francis Kwame Yeboah, counsel for VRA, had informed the Court that he filed an application in opposition only Wednesday.
The Court, therefore, said it would be expedient to ensure that Counsel on the other side was first served with a copy of the application before the suit could be heard.
Accordingly, it adjourned proceedings to February 6, when it would go into the merits of the matter.
Initially, Mr Akoto Ampaw, Counsel for Dr Wereko-Brobby, prayed the Court to award cost against the VRA for wasting the Court's time. According to Counsel, he filed the processes as far back as December 14 2006 and that Counsel on the other side, who was served the following day, could have responded two weeks later.
In Mr Yeboah's view, the application was filed during the Christmas period, and, therefore, he could not have responded at any opportune time than now.
After listening to Counsel's explanation, the Court waived the cost, which Mr Ampaw wanted for his client.
In Dr Wereko-Brobby's statement of claim, the VRA per its April 1, 2004 letter, agreed to pay 70 per cent of his entitlements by mid-April 2004, and the remaining 30 per cent when he vacated the institutional premises of the Authority.
The VRA, according to the statement of claim, failed to honour its promise, and the delay in paying the entitlements persisted into the following year.
On January 1, 2005, Dr Wereko-Brobby vacated the premises although he was not paid the entitlement.
The statement of claim indicated that a series of correspondence between Dr Wereko-Brobby and his former employers afterwards did not solve the matter.
This compelled him to take the legal action against the Authority. Speaking to the press afterwards, Mr Yeboah indicated that there might be an out-of-court settlement of the matter. 25 Jan. 06
