Apart from evidence and testimonies given in court, judges are obliged to consider behaviour of defence and prosecuting parties to determine elements of lies and truths in persons appearing before them. I believe it is upon that basis that the statement was admitted in court records.

Besides, it is illogical for Godfred to tell us outside court (court of public opinion tainted with PR gimmicks) proceedings that he illegally met accused on 5 occasions without his counsel as well as failing to report to authorities if in deed he considers the meetings were intrusive and subversive. Finally, does his conspicuous consideration of not proferring charges against him equalling no case and or efforts not to open the Pandora box further?

Jakpa Ndula has done anything so spectacular. He will regret his actions. Plea bargain is a discretionary process for prosecutors to engage in what they call “ turn the tide”, the prosecution is allowed to talk to those accused who are considered victims, especially those who are used as conduits. The prosecutor can cut a plea bargain with such victims to testify against their co- conspirators— for a lesser sentence. In other terms, the prosecutor may seek to convince potential victims to refuse to assume responsibility for their lesser role in crimes committed against the state by testifying against the more powerful culprits in return for a lesser punishment. If it becomes worst the judge can refer the case to a Special Prosecutor.
