ALL Foreigners-that is coloured people-BLACK PEOPLE in France, Germany, Belgium, Holland etc etc are REQUIRED BY LAW to carry their immigration documents every day every where they go outside their house. When I first went to Germany from the UK, the following day-My friends told me to take my passport with me when we were going outside. I asked him why? My friend told me that is the RULE in Germany here. Immediately we stepped outside, we drove for about 5 minutes and we saw a Car Dealership. We stopped there to look at some cars-whilst standing out-a German Policeman drove by and stopped and asked ALL OF US OUR IMMIGRATION PAPERS. after IO have shown the Policeman my passport-I told the policeman-it is NOT like that in the UK. The German policeman retorted-you BETTER GO BACK TO England. I took a picture with that German Policeman. When I left German-We drove to Belgium and whilst in Ostend-a Belgium Police van came to us to ask for our immigration papers again in Belgium. I was on a TRAM-small Railway in Holland-Armsterdam and the Immigration came to check on our immigration papers. I DO NOT WANT TO GO ON-AND ON. YOu are A BLACK MONKEY. Your land is AFRICA. Now when a document is presented in court, it will before then be in the Statement of Claim that they will show evidence to the court during testimony.

Ok, When the claimants lawyer is on his/her feet, the document is produced and commentary is made in it (Show and tell). Even before this time, the other party would be made aware of that document in the case conference or the case management stage depending on the type of case.

Sometimes, its submitted there then it is argued for or against and then the document will go in. Sometimes, the lawyer will therefore ask to provide it at hearing. Depending, the judge and the other party will agree. This case partly relies heavily on the marriage certificate so i am sure Serwaas lawyer requested to tender it at hearing which was allowed.

At hearing, note that the claimant, respondent AND THE JUDGE have a duty to justice and the RULE OF LAW. Therefore, the judge can also authenticate a document to ascertain its veracity. For example a judge who is a commercial law judge will know the security features on a company certificate. That judge can scrutinise any document in his preview and ask questions. If the lawyer who presented it still insists, the judge will just create a folder with a reference number for the document then make a direction instantly to refer the document to the appropriate authorities to authenticate.

Specific to this case: What we know is that Akosua Serwaas lawyers tendered PHOTO COPIES to the court. This is in the public domain and a fact. Hahahahahahahahahaha. I laugh loud. NO COURT IN THE WROLD WILL ACCEPT such a document especially as it is a Family Law matter. The judge can be disciplined. My friends, you know why Akosua Serwaa brought copies of a a supposed GERMAN Marriage Certificate in court? If she brings an original copy, the judge would definitely have referred it to the German Embassy, Viola. Akosua Serwaa is in trouble.

Two things: I believe strongly that, that original copy would have been fake then perjury. Secondly, remember Akosua Serwaa presented drinks to Lumbas family towards her divorce from Lumba. I believe strongly that she did that because she married another man either in Germany or in Ghana.

I tell you. In the Western world, bigamy is seen as a very very serious offence. If an original document gets to the German authorities, they will definitely scrutinise it to the core. I can bet my life on that.

Akosua Serwaa's lawyers should be referred to the Disciplinary committee because there is no way that a matrimonial matter will be decided on a photocopy of s supposed marriage certificate. Believe me, in England, it will be a disciplinary issue and a very serious one. This is first year law School matter.

You are only basing your comments on assumption.It is pure rubbish. Certified copies are accepted everywhere in the world. the least they could do was to verify it officially from the German Embassy. secondly, Both Lumba and Madam Akosua Serwaah are German nationals. They have renounced their nationalities. arguably, this case is beyond this jurisdiction.Had Lumba immediate family seeked help to fly the copse back to Germany, the German Embassy would have assisted them .

They will never ever accept a copy of a marriage certificate. Look on each marriage certificate. It is written that it should be kept very well and not to be destroyed or defaced or words to that effect. There is a reason why.

The court could forward it to the German Embassy to verify if they presented an original marriage certificate my friend. That is very very easy. Akosua Serwaa could have applied for another marriage certificate easily from the German authorities to present to the court.

Think about it. Why do you think the judge said the copies of the marriage certificate is not admissible? Why? It is a court my friend.

In matrimonial matters, original marriage certificates are used in court and never copies.

I tell you, this is first year Law School stuff.

Notary Public in Germany are Lawyers with special authority.Bear with me that the Appeal court will definitely rule in favour of Madam Akosuah Serwaah and reverse the lower court decision. Let's deal with the simple issues,the basic things.
When it comes to documents,certification is key.
When it comes to certificate,authencity is very crucial.
Here we are talking about "original and certified document".
These are "technical terms" so far as administration is concerned.
Another issue is the "translation of language".
In some strict institutions,"only certified translators"have the right to do this job.
I think Serwah was unable to present the "original marriage certificate" according to the judgement.
I also think the translation was not done by the right professional.
These are some of the technicalities that beat Serwah's lawyer.Tnx.

According to the judge, the evidence submitted “fell short of Sections 136 and 161,” which require the plaintiff to submit the original marriage certificate from the Bornheim Marriage Registry and the corresponding certification from the Ghana Embassy in Germany. Instead, what was provided was only an extract. Also, under the Evidence Act, the plaintiff was required to present “a recognized German civil marriage expert” to testify, but she did not. Let's all note that the burden of proof of civil marriage is on the plaintiff. The judge raised this concern earlier in the case but nothing was done to correct it. Bottom line is, they went to court unprepared. They screwed up thinking they are dealing with a village case.

Why in the name of God, is it 48 pages now? All what you have written is factually inaccurate. They had presented a certified copy which is normal in Germany. I have lived in Germany for more that 40 years and German Embassy wouldnt have ever confirmed the marriage with an official letter if it is not authentic. You are only basing your comments on assumption.It is pure rubbish. Certified copies are accepted everywhere in the world. the least they could do was to verify it officially from the German Embassy.Is that how you practise the common law in Ghana. It is shameful. This is a civil case not a criminal case.Even in criminal case, they may verify.
Secondly, Both Lumba and Madam Akosua Serwaah are German nationals.
