Unfortunately, the bitter truth is that the lawyer is making weak claims regarding so-called prejudicial statements. What makes this lawyer think that Marco Rubio will stand in the way of extraditing Ken Ofori-Atta to Ghana? What Ghana needs to demonstrate at that extradition hearing is sufficient proof that Ken engaged in the corruption that he's accused of, and failure to convince the court will mean that Ofori-Atta can't be extradited. It's up to the hearing Judge to decide whether enough proof has been submitted to warrant an extradition. This lawyer can't ask readers to mark his words when he's neither the hearing Judge nor a part of the team of lawyers that will be defending Ofori-Atta at the hearing. At this point, no one can predict the outcome of the hearing since it's not clear what defense Ofori-Atta will mount at his hearing or how Ghana will make it's case.

I have been saying this all along. I am an American with over 20-years of legal experience. The courts are going to look at everything.

1. Reasonableness: Unlike Abu Trica, Ken had a long history of success before he assumed the role of Finance Minister. The court is going to ask if it is reasonable than Ken did not loot Databank -- it would have been far easier and less likely to trigger prosecution -- but then suddenly decided to loot Ghana.

2. Charges: The court is going to question whether or not Ken broke any US laws. Nothing on the charge sheet indicates that he did.

3. Due Process: Ghana broke protocol with its premature issuance of the Interpol Red Notice. That lack of restraint will be viewed as a systemic failure.

4. Posture: The AG's posturing of not being afraid of a more-disciplined judicial process won't play well in front of a US audience. The AG clearly confuses "mutual agreement" with "equal partners". Ghana is barely larger than the smallest American state. It is a debtor nation, so it has not earned the right to be arrogant.

5. Reputation: Ken's reputation is golden inside D.C. circles. Ghana's courts are viewed as both contemptible and corrupt. Given the OSP's failure to secure any convictions to date, this attack on Ken might be viewed as a witch hunt.
