Wontumi has admitted being owner of Akonta mining by document and audios, Wontumi Akonta mining company Manager admitted sub contracting forest land to another company ( Galamsay) . The sub contractor manager admitted that Wontumi gave him permission to mine verbally. Even using national security to protect them . So Wontumi is very aware of Galamsay boys in the forest. Wontumi admitted on tape audio to police detective of mining activities in the forest. No permission sort from mineral commission to sub contract the forest. Remember, Wontumi has only exploration license to that forest.

If a car is purchased and registered to a person then it is the responsibility of the owner to know the whereabouts of the car or at the very least have an idea what the car is being used for if released for use by someone else. As the saying goes, ignorance is not a legal defense and it baffles me that the land that is leased and licensed to Wontume and his Akonta Mining could be used by others illegally while he claims he is unaware that the site is being misused by others.

Would the courts and the opposition NPP accept as legitimate excuse if the office of a minister is being used by others for illegal activities if the minister or the NDC government went to court to say they did not know of illegal activities at the offices because the minister was at home on sick leave?

Let us stop the nonsense lest we become a nation of classroom educated fools. The courts cannot allow people to hold license and claim ignorance for the use of the very license which gave the bearer of the license both privileges and responsibilities.

Where in the constitutional laws of Ghana does a statute absolve license holders from illegal use of their licenses? The owner of a registered firearm is the first suspect to be interrogated if the firearm is used in a crime especially if the owner of the firearm has neither reported it stolen to the proper authorities, obtained formal copy of said report and cannot account for the whereabouts of the firearm. It is not the state that has to prove beyond reason that the owner committed the crime; the state can prove based on the preponderance of evidence that includes ownership of the firearm, lack of reported missing of said firearm and ballistic proof that the bullet came from the firearm identified as belonging to the suspect.

The issuance of mining license to Akonta mining and its owner Wontume comes with responsibility of use of the license and of the licensed zone. At the time of Wontume's arrest and charge, neither him nor representative from Akonta Mining had officially relinquished license at the zone back to the appropriate government agency. For all intense purposes, any and all activities at the site is the responsibility of Akonta mining and Wontume.

I am of the opinion that the government should not be burdened to prove that parties arrested for illegal mining activities at the site licensed to Akonta mining and Wontume did or did not receive authorization. Was Akonta mining and Wontume not required to complete all necessary land reclamation after their mining activities were completed? Was Wontume and Akonta mining not therefore responsible for use of the site until site is returned to government?

We will be unnecessarily burdening state security agencies if they are required to be "watch men" for owners and licensed mining operators; anyone in Ghana who believes that Wontume and Akonta mining managers were deaf, dumb and blind while the presumed illegal mining took place is just as dumb as trained elephants in a circus.

Gov says he released the concession to persons without informing the Minister.
Wontumi says he didn’t engage a 3rd party,so there is no agreement to start with.
Gov AG couldn’t show evidence that there was an agreement between Wontumi and the 3rd party.
Wontumi says he has no CASE to answer.
