A private legal practitioner, Kwame Adofo, is calling for the resignation of the Special Prosecutor, Kissi Agyebeng, following a recent High Court ruling that has sparked debate over the powers of the Office of the Special Prosecutor (OSP).

Speaking on Asempa FM’s Ekosii Sen programme, Lawyer Adofo did not hold back, questioning Agyebeng’s continued stay in office and criticising his handling of the mandate entrusted to him.

“I’m surprised he hasn’t resigned by now, as all his cases are null and void. I don’t understand why he is still being paid. Kissi Agyebeng has caused enough issues, and it’s time for him to go,” he stated.

His remarks come in the wake of an April 15, 2026, ruling by an Accra High Court that the OSP cannot initiate or prosecute criminal cases without prior approval from the Attorney-General.

The court also directed that all ongoing criminal cases being handled by the OSP be transferred to the Attorney-General’s Department.

For Lawyer Adofo, the decision has far-reaching implications. He argues that the ruling effectively invalidates the OSP’s current prosecutions and underscores the need for the office to operate strictly within the legal framework.

He believes the situation calls not only for a leadership change but also for proper legal backing to ensure the office functions effectively.

“The parliament has stated that his mandate requires authorisation from the Attorney-General, rendering all current cases void. If the Office of Special Prosecutor (OSP) had the necessary executive instrument from the Attorney-General, he would be able to prosecute.

“The authorisation is what he needs to work effectively. The real problem lies with the people in the office, so if we could get someone more credible and provide them with the appropriate authorisation, that would be beneficial,” he said.
