Stay of execution if granted doesn't mean the applicant can continue to do what the judgment stopped. It just means the winner wouldn't go into execution until the applicants appeal is heard and determined so that if he wins the appeal the victory doesn't become nugatory or useless. Its therefore wrong to say once the OSP has filed for stay of execution it can continue it's operation like to carry on prosecutions.
