The rearrest of former Chief Executive Officer of the National Food and Buffer Stock Company (NAFCo), Hanan Abdul-Wahab and his wife, Faiza Wuni, barely two hours after charges against them were formally withdrawn in court, has reignited controversy over the state’s prosecutorial approach.

Kwesi Botchwey Jnr, a lawyer and member of the New Patriotic Party Communications Team, has reacted to this development.

According to him, the state’s decision to withdraw charges only to rearrest him two hours later raises serious concerns about due process.

Speaking in an interview with JoyNews on Wednesday, May 6, 2026, he said, "The state’s decision to withdraw charges only to rearrest him 2 hours later raises serious concerns on due process and the use of prosecutorial powers.

He argued that what happened in court creates the impression that the government is trying to abuse their discretion to prosecute individuals, stressing that the pattern is quite worrying.

Botchwey went on to recount the ordeal the accused has faced since their initial arrest in early 2025.

He noted that Hanan was detained for more than 30 days before being granted bail, but the conditions imposed were “unreasonable.”

“This was a person who was arrested in the early days of 2025 for allegedly committing some criminal offences. He was arrested by EOCO, he was detained for over 30 days, he was granted bail but subjected to unreasonable conditions to the tune of about GH¢200 million together with the wife, and it took them forever to be able to meet the bail conditions.

"They had to actually go to the court to waive the bail term conditions for them and so on and forth,” he explained.
