President Mahama petitioned to remove Court of Appeal judge

President John Dramani Mahama has been petitioned to initiate proceedings for the removal of Justice Daniel Mensah, a Court of Appeal judge, over allegations of “stated misbehaviour.”

According to dailyguidenetwork.com, report on May 6, 2026, the petition, dated April 7, 2026, was submitted by private citizen Rocky Ofori under Article 146 of the 1992 Constitution.

It accuses Justice Mensah of actions that allegedly undermine judicial authority and erode public confidence in the judiciary.

According to the petition, Justice Mensah supervised elections for the Bono Regional House of Chiefs despite a related case being pending before the High Court in Kumasi.

The Electoral Commission had declined to conduct the elections due to the ongoing litigation, yet the judge allegedly proceeded to oversee the process, participated as a candidate and later swore in the winners.

The petitioner argues that this conduct raises serious conflict-of-interest concerns, violates the principle of sub judice and directly challenges judicial authority.

Another claim is that Justice Mensah allegedly disregarded a High Court order recognizing Nana Samgba Gyafla II as the Paramount Chief of the Sampa Traditional Area, an act said to undermine the authority of the courts.

Ofori has urged President Mahama to refer the matter to the Chief Justice, as required under Article 146, to determine whether a prima facie case exists for removal.

The petition stresses that while constitutional protections safeguard judicial independence, they also ensure accountability when judges act in ways that compromise the integrity of the judiciary.

“The conduct of His Lordship Justice Daniel Mensah constitutes stated misbehaviour that strikes at the very foundation of the rule of law and the authority of the courts,” part of the petition reads.
