Court rejects attempt by Adu-Boahene to tender email correspondence as evidence

The High Court in Accra reportedly rejected a move by lawyers for embattled former Director General of the National Signals Bureau (NSB), Kwabena Adu-Boahene, to tender a document during court proceedings on May 12, 2026.

According to a report by TV3, the said document was an email correspondence between the 3rd prosecution witness, Mildred Donkor, and the insurance company, Petra, when she was the director of Advantage Solutions, one of the companies owned by Adu-Boahene.

Donkor, who became a prosecution witness after the state dropped the charges against her in the case, told the court that Advantage Solutions had several employees who received monthly salaries as well as pension contributions, adding that the company was not engaged in any criminal activities.

The report indicated that the witness made these comments as she was cross-examined by the lawyer for Adu-Boahene, Samuel Atta Akyea, who also made her confirm that the pension contributions of Advantage Solutions were being handled by Petra.

Atta Akyea then tried to tender an email correspondence between Mildred Donkor and Petra, but this was opposed by the Deputy Attorney General and Minister of Justice, Dr Justice Srem-Sai, who was representing the state.

The Deputy Attorney General argued that the document was irrelevant to the case because it was exchanged in 2024, which was well after the crimes Adu-Boahene had been charged with were allegedly committed.

“Atta Akyea then sought to tender email correspondence between Mildred Donkor and an official of Petra, along with receipts of pension payments, to demonstrate that the company was not engaged in any criminal enterprise as alleged by the prosecution.

“However, Deputy Attorney General, Dr Justice Srem-Sai, objected, arguing that the correspondence took place in 2024, several years after the transaction for which the accused persons are standing trial,” a TV3 reporter said.

The reporter indicated that the trial judge ruled in favour of the state and upheld the objection raised by the Deputy Attorney General.

“The court subsequently rejected the documents as evidence, ruling that they had no bearing on the case before it,” the reporter added.
