The High Court will, on Monday, June 15, 2026, deliver its ruling on an application for a stay of execution filed by the Office of the Special Prosecutor (OSP).
The development was disclosed in an X post shared by TV3 on June 8, 2026.
According to the post, the OSP has filed an application for a stay of execution and a notice of appeal against a High Court ruling that directed the Attorney General to take over prosecutions initiated by the anti-corruption body.
OSP shares latest update on prosecutorial mandate case
“The High Court has announced that it will deliver its ruling on the Office of the Special Prosecutor's application for a stay of execution on Monday, June 15,” the post stated.
The ruling being challenged held that the OSP requires specific authorisation under its enabling law to prosecute criminal cases. In the absence of such authorisation, the court declared prosecutions initiated by the OSP invalid and ordered the Attorney General to assume responsibility for those cases.
The issue arose during proceedings in the Strategic Mobilisation Limited (SML) case involving former Finance Minister Ken Ofori-Atta.
Following the ruling, a number of cases being prosecuted by the OSP were adjourned pending a determination of the agency's prosecutorial mandate. These include the SML case and the National Petroleum Authority (NPA) case involving Mustapha Hamid.
