Ex-MASLOC CEO's Acquittal: Legal issues the state may raise at Supreme Court - Lawyer details

Private legal practitioner, Maurice Ampaw, has outlined some of the legal issues the state is likely to raise as it begins the process of challenging the Court of Appeal’s decision to acquit and discharge former MASLOC CEO, Sedina Tamakloe-Attionu, at the Supreme Court.

The Attorney General has announced plans to appeal the Court of Appeal’s ruling, which overturned Tamakloe-Attionu’s 10-year prison sentence after the court held that the prosecution failed to prove the charges against her beyond a reasonable doubt.

Explaining the possible grounds the state could rely on in an exclusive GhanaWeb interview on July 30, 2026, Lawyer Ampaw said the Attorney General may argue that the Court of Appeal’s decision was unfair to the state and should be overturned.

“They might say that they disagree with the decision of the Court of Appeals. When it goes to the Supreme Court, they could also raise the issue that the ruling of the Court of Appeal has done injustice to the state, so they will challenge the decision,” he said.

He added that the state could also challenge the reasoning of the Court of Appeal by arguing that the prosecution had provided enough evidence to secure a conviction.

Lawyer Ampaw explained that the Attorney General could contend that the appellate court’s decision was unreasonable and amounted to a miscarriage of justice.

“They can also challenge the decision of the Court of Appeals and say that the decision is unreasonable and the state was able to prove their case beyond a reasonable doubt; therefore, the decision of the Court of Appeals is a source of miscarriage of justice, and that is what they can challenge,” he added.
