Lawyer for the Member of Parliament for Ofoase Ayirebi, Kojo Oppong Nkrumah, Frank Davies, has said that the legal team will accept the Supreme Court’s decision to dismiss their application challenging the constitutionality of legal vacation trials.

This follows the Supreme Court’s dismissal of the injunction application filed by Oppong Nkrumah, on Friday, August 21, which sought to prevent the use of legal vacation for trials.

Speaking after the ruling, Davies said lawyers must respect decisions of the court even when they do not go in their favour.

“As trained officers of the court, when you come to court with an anticipatory mind, when you have an injunction, whatever application you have before the court, it either will be refused or will be granted,” he said.

He said the legal team would not attack the judge over the decision and would instead study the full ruling before deciding on the next step.

“So yes, the judge has made a determination. It is not in our place as lawyers to condemn the judge. We can only critique. The plaintiff has told you, in a very short time, his understanding of what happened in the courtroom. So, we will abide the ruling of the court for now,” he stated.

Davies also said the legal team would not join lawyers who publicly criticise court decisions simply because the outcome was not in their favour.

“We are not given to say the things other lawyers say when decisions of the court are handed and doesn't go in their favour. We will not repeat those chants because they don't sit in our usual lexicon as lawyers. So yes, we accept the ruling of the court for now,” he added.

He said the lawyers had applied for a certified true copy of the ruling to enable them to examine the reasons behind the court’s decision and advise their client on the way forward.

“We have applied for a certified true copy of the ruling, which the registrar has promised so to do… So we shall apply for it when the ruling is handed to us. We shall read in detail the reasoning and appropriately advise our client,” he added.
