Sky Train Case: Ex-GIIF CEO files Supreme Court application after failing to file defence

Lawyers for former CEO of the Ghana Infrastructure Investment Fund (GIIF), Solomon Asamoah, have filed two applications at the Supreme Court after he failed to file his defence in the ongoing case involving him and former GIIF Board Chairman, Professor Christopher Ameyaw-Akumfi.

The development was disclosed by Deputy Attorney General and Minister of Justice, Dr Justice Srem-Sai, in a post on X on Saturday, August 22, 2026.

According to him, the two accused persons have still not filed their respective defences despite being given additional time by the trial court.

He stated that on July 2, 2026, the trial court dismissed the submissions of no case filed by Mr Asamoah and Prof. Ameyaw-Akumfi and directed them to file their defences within 21 days if they wished to do so.

However, when the 21-day period expired, neither accused filed a defence. Instead, they filed applications seeking a stay of proceedings.

“On July 2, the trial Court dismissed the two Accused Persons’ submissions of no case, and directed them to, within 21 days, file their respective defences if they wish to. On the 21st day of the directive, none of the two Accused Persons had filed a defence. Rather, they filed an application for stay of proceedings,” he wrote.

Dr Srem-Sai indicated that on July 30, the court granted the two accused persons an additional 21 days to file their defences, bringing the total period granted to 42 days.

The case was subsequently adjourned to Monday, August 24, for a case management conference.

According to Dr Srem-Sai, however, Asamoah’s lawyers went to the Supreme Court on Thursday, August 21, a day after the additional 21-day period had expired.

He said the lawyers filed two applications, including one seeking an order from the Supreme Court to quash the trial court’s decision dismissing the submission of no case.

“The first application is for an order of certiorari to quash the dismissal of the submission of no case and the variation of Solomon Asamoah’s bail conditions,” Dr Srem-Sai stated.

The second application seeks to halt proceedings in the case until the Supreme Court determines the certiorari application.

“The second application is for an order of interlocutory injunction pending the determination of the certiorari application,” he added.

Dr Srem-Sai noted that despite the applications before the Supreme Court, neither Asamoah nor Professor Ameyaw-Akumfi has filed a defence before the trial court.

The application for an interlocutory injunction has been scheduled to be heard by the Supreme Court on Thursday, August 27, 2026.
