Akufo-Addo does not only need to “to come and explain to us (Ghanaians) why they terminated the service of solicitors we contracted in the U.K”, he needs to give reasons why he should not be given a long jail sentence for causing financial loss to the state!

He should be jailed for criminal negligence! The whole thing looks as though the NPP wanted the Société Générale to win the case against Ghana!

It is about time Ghanaians terminate the wicked practice of politicians who hover over Ghana like vultures looking for carcass and create the enabling environment to siphon off such large sums into the pockets of their foreign benefactors whilst they themselves are even satisfied with peanuts!

What marvellous stupidity is this? And he wants to be made President "at all cost"? No wonder he resorted to the slogan of armed robbers: "all die be die!"!

The US Courts refused to seize the ship on jurisdictional grounds not on the merit of the case..Therefore. Agalga's assertion that Societal Generale was going to lose the case in the British Courts was groundless. GNPC owed the money and it had defaulted. The ship, that was pledged as collateral, had been seized and was eventually going to be liquidated to pay off the debt after judgement. It was therefore prudent to reduce the debt by settlement and sell the ship to pay

And when our int`l attys were unceremoniously fired by the AG dept, that inexplicably failed to show upn court,the court had little choice but do the bidding of SG. We have seen the same thing happen here in our own courts where govt attys,either by accident or design,consistently fail to show up in court to defend the interests of the state. In this particular case, I will dare say this strange happening, was an accomodation the new players on the block,had reached to enable SG take us to the cleaners.
So this 'Ananse' tale about "jurisdictional grounds" is only a fiction people like you and Kweku Baako are putting forward to conceal the truth! If it was a simple matter of jurisdiction, and that SG had a water-tight case,where else could it have suceeded than in Panama?

It was evident from the onset that they were full of themselves and instead of allowing themselves time to learn the ropes, they embarked on grand stand decisions making gestures interlaced with bent law enforcement measures in order to impress . How could a lawyer who was a general legal practitioner come in and be made an Attorney General and overnight acquire the expertise to make decisions about complicated financial measures such as derivatives?

Here was a Minister who was not prepared to allow the Solicitors who were dealing with the issues before he came into office, the room and time to complete their job for the sake of the national interest. He and his colleagues were more interested in playing politics and in the end cost and lost Ghana a lot of money and assets

At least the Sole Commissioner appointed by this new President Mahama, will delve into some of these very bad decision making and allow Ghanaians to gain some insight into what the NPP did with the resources of Ghana while they were in office.

It has come to our attention that the sale of GNPC vessel MV511 to settle the so called judgement debt incurred as a result of administrative and financial differences between the GNPC and Societe General is been turned into a rationalization of reckless and unpatriotic episode by the NPP.
We of the MAG wish to condemn the act of the then Minister of Energy Hon. Kan Dapaah, his deputy Hon. K.T. Hammond and Minister of Justice and Attorney General Hon. Nana Addo Danquah AKuffo Addo and in general the Kuffour administration.
We are doing so because of the indifference and careless manner spokespersons of the NPP are making about the saga.
We ask the following questions:
(1)Who were the advisors for the whole transaction up to the point of sale of the ship?
(2)Was there value for money in the valuation of the ship?
(3)Was there any judgment in respect of the case?
(4)Per the Bank of Ghana Act; Act (612) the Bank of Ghana shall lead in any financial transaction, be it local or international. So the question is, was the Bank of Ghana involved in this transaction?
(5)Was payment made in cash or cheque?
(6)If it was cheque, how was it disbursed?
(7)By whose consent was it disbursed?
(8)Who authorized the payment of up to $ 1 million (One Million US Dollars) as legal fees?
(9)Where is the balance of $ 3.5 million?
(10)Why were the first external Solicitors withdrawn from the case?
(11)Why did the new Solicitors led by Nana Akuffo Addo failed to appear in court on several occasions?
(12)Was there any sinister reasons for so doing?
We asked the above questions for and on behalf of the million Ghanaians and plead with Civil Society Organizations to do same so that the running of corporate Ghana should never go down there again.
Finally, these questions demand answers from Kuffour led administration, the then Attorney General Hon. Nana Addo Dankwa Akuffo Addo and the then Minister of Energy and his deputy Hon. Kan Dapaah and Hon. K.T. Hammond

AGAIN, GHANAIANS SHOULD UNDERSTAND WHAT IS LEGALLY KNOWN AS SET-OFF IN FINANCIAL TRANSACTIONS. WHAT SORT OF RISKS CONTROLS DID TSIKATA AND HIS THEN GNPC DID PUT IN PLACE.
IN BANKING WORLD IF YOU HAVE A PROPERTY AS A MORTGAGE, COLLATERAL OR ANY FORM SECURITY EITHER AS A FLOATING OR FIXED ASSETS AND THE BANK FORECLOSE DUE TO DEFAULT REPAYMENT, THE BANK HAS EVERY RIGHT TO SELL THE PROPERTY AT A REASONABLE PRICE UNDER THE TERMS OF THE FINANCIAL CONTRACT.
IF THEY ARE ABLE TO SELL THE PROPERTY UNDER A BULLISH MARKET THEY WILL APPLY THE RULE OF SET-OFF AFTER TAKEN INTO ACCOUNT ALL OTHER CHARGES RELATING TO THE FORECLOSED ACCOUNT.
HOWEVER, IF THE CUSTOMER IS FORTUNATE IN BULLISH MARKET SITUATION AND THE BALANCE RESULTS IN CREDIT POSITION IN FAVOUR OFF THE CUSTOMER, THE BANK WILL THEN ISSUE A CHEQUE PAYABLE TO THE CUSTOMER, CONVERSELY THEY WILL CHASE THE CUSTOMER TO PAY THE DIFFERENCE. THIS HAS NOTHING TO DO WITH POLITICS, IS THE APPLICATION OF LAW AND PRACTICE OF BANKING.
NOTWITHSTANDING, TSIKATA AS A CRIMINAL LAWYER WHO HASN'T GOT A CLUE ABOUT THESE BANKING AND FINANCIAL LAWS.
GNPC AND TSIKATA TOOK A POSITION WHICH BECAUSE OF LACK OF DEVELOPING A TRADING STRATEGY RESULTED IN A HUGE DEFICIT WHICH SG BANK FORECLOSED THE ACCOUNT AND SOLD THE COLLETERL. THEY THEN SET-OFF WHICH AS EXPLAINED ALREADY A NORMAL PRACTICE. THEREFORE GIVING THE NET BALANCE TO THE DEPUTY MINISTER IN A FORM OF A CHEQUE PAYABLE TO THE REPUBLIC OF GHANA WAS ABSOLUTELY CORRECT.
MY PROBLEM IS, WHY KT HAMMOND FAILED TO MAKE PHOTOCOPIES OF THE CHEQUE AND ALL THE ATTACHED LETTERS AND DOCUMENTS. WHEN THE CHEQUE WAS HANDED TO MINISTRY OF FINANCE WAS IT THROUGH
MINISTERIAL PROTOCOL AND FROM MINISTRY OF FINANCE TO BANK OF GHANA WHAT FORM OF DESPATCH SYSTEM IN A FORM OF VALUE CHAIN IS IN PLACE.
GHANA MINISTRIES AND OTHER STATE INSTITUTIONS ARE PRACTISING IN THIS POSTMORDERN ERA AS IF WE ARE IN THE GUGGISBERG DAYS. A TYPICAL EXAMPLE IS REGISTERING A VEHICLE AT DVLA AND WANTED TO CHANGE ITS USE FROM PRIVATE TO COMMERCIAL. WITHIN A PERIOD OF 30 DAYS DVLA WILL COME BACK TO TELL YOU THAT THEY CAN'T TRACE THE VEHICLE DOCUMENTATION, I'M A LEAVING EXAMPLE TO THIS FACT. THEREFORE I'M CHARGING MINISTRY OF FINANCE AND BANK OF GHANA TO PRODUCE EVERY TRANSACTIONS TO UNRAVEL THIS PROPAGANDA PERSUIT WITHIN 14 DAYS UNLESS THEY COME BACK TO TELL GHANAIANS THAT ALL DOCUMENTS HAVE BEEN SHREDDED.
