This mathematics which can even be done by a BECE candidate who cannot write his final exams without questions leaks, and could not be done by President Mahama nor Seth Terkper as they want us to believe, will reveal to us how deliberately corrupt and financially reckless they are as far as the management of our economy is concerned. The Eurobond attracts an interest of 10.75% to be paid by the government of Ghana, $250m out of it is illegally deposited in UBA, a private bank. The bank, which is UBA in turn, decides to buy GHS 950 million of government Treasury bills at a rate of 24% (using the 1-year note); the bank would have made a hefty GHS 233 (USD 61) million profit in nominal terms just by loaning this same money to the government. Friends in the media, if this is not a 419 scam visited on unsuspecting Ghanaians by President Mahama, then what else is it? – Meanwhile, this is a President who is walking freely on the streets of London shamelessly mocking Ghanaians that he has never taken bribe, my goodness!!! Note therefore, that Government is paying 10.75% 24% which is 34.75% interest on the money he borrowed from the capital market. Government is paying 24% interest on his own money to a private firm. Is this sheer wickedness, foolishness, witchcraft or what? We cannot help, but agree with Nana Konadu Agyeman Rawlings when she posited few days ago and I quote, “If you borrow money at a high interest rate to lend it to another at a low interest rate then borrow your own money back from them at a high interest rate, you are either not wise, a thief or both. No wonder their campaign message of “vote for us so they don’t jail us, it’s time to save Ghana from this criminality”. During the 2012 election petition all objections raised by the NPP and ruled upon by the Judges had Justice Anin Yeboah supporting the NPP. He was always on the minority side. If it was only one dissenting view,it belonged to Anin Yeboah. During the Tsatsu Tsikata's case, he deliberately misinterpreted the law only to allow Tsikata to lose the case. Justice Anin Yeboah and Justice Henrietta Abban are in the same group of people who hate NDC to the bone. Is Justice Anin Yeboah telling us that he is wiser and knows the law better than the other 4 Judges?

I think it is rather you and some others who are not using common sense. The Const. is clear that you can't be an MP if you are not a registered voter, NOT you can't be a parliamentary candidate, that's a POTENTIAL MP, if you are not a registered voter. Zanetor is not yet an MP, but just hopefully one should she win the elections. She might not win, so whence the suit then? Not frivilous and redundant? You can't be sued for an offence you haven't committed, not that it doesn't happen with innocent persons sent to jail or even executed. This law is designed, just as all laws are designed, to punish actual commissions of offences and intentions to commit a crime, and, of course, deter their commissions. But we must have reasonable proof of the intention of a person to commit a crime before we can charge him with attempted crime, e.g., robbery. Was Zanetor intending to contest for the MP position without ever registering as a voter? I don't think any sane person would say yes to that.
Now, it'd be very unfair to prevent me from contesting a party's primary to become MP should I return home at a time such a primary was being held and the EC was not holding one of its so-called limited registration or whatever to afford me the chance to register as a voter and then contest in the primary. My right is denied then. That's why the EC must have a continual registration of voters, as some are urging now.
I side with the majority in the SC and urge them to go ahead and overrule the High Court Judge and interpret those provisions in favour of Zanetor and all others like me in the future even though I don't side with her decision to contest that seat, registered as a voter or not. This issue is much bigger than Zanetor and the NDC. It is a national issue.

Anin Yeboah's long and winded decision is a mere ruse to muddy the waters, and exacerbate the split within the support base of the NDC in the constituency!
Let's face it, how can you agree to be a member of panel hearing a particular suit, and then turn around and declare that the SC's intervention was unwarranted?
Which of our courts has the jurisdiction to consider matters concerning the true and proper interpretation of constitutional provisions?
was this same Judge, not the leader of the 'pack' sitting on the apex court, which provided the 'oxygen' for an election petition which clearly lacked merit, but vainly sought to make an obvious election loser, into a winner, and thus become a President through the backdoor, rather than the ballot box?
Were the hearings ended, when the the petitioner's 'star witness', in person of Bawumiah, who had sworn and signed all affidavits, forced to concede under Tsatsu's blistering cross examination, to cough up the now famous refrain: "You and I were not there"? Did the SC have to waste any more of our time and precious resources, after that 'fatal' confession and 'spectacle' in open court?

I am no lawyer but as a State Formation and Building specialist, a field of learning that trumps law,the way some Ghanaian lawyers and judges in particular treat the law leaves me cold. The law is simply a tool for rational governance as accounting is to proper business management.
Luckily for us, the expert knowledge of the Chief Accountant does not always overrule the decision of the CEO, who btw, might even be qualified as accountant too. So must it be in proper state building too, with politics trumping the law in a positive manner for the greater good, of course. As K.C. Wheare pointed out in his classic, Constitutions, the courts help in changing Constitutions by their rulings, being one of the ways Consts. change without formal amendments.
To me, it is clear that the High court Judge has interpreted a Const'nal provision in a perverse way, which would impact all other persons in Zanetor's position in the future. The SC must come in and purge that interpretation by a lower court. As I have argued below, simple common sense must prevail.

I disagree if he says, there is no ambiguity in the interpretation of the above article and I shall espouse reasons to support my argument.
1. If he toes the legal grounds of the High court judge then he has gravely erred in law and common sense and logic.
Reason: without ambiguity Article 94(1)(a) has about three precursors or pre-requisite; nationality, age, and eligibility to vote by been a registered voter.
An individual who satisfies the nationality requirement could simply fault in the other two. If am 17yrs in an election year, this would imply am ineligible to own a voters card. In the next election year I would be 21 and qualify to contest on any ticket for parliamentary slot. It is reasonable to say so, right?
Now the crux of this analogy drives at the point that, if the said article was not very much confusing to JJC Ennin Yeboah, he would have considered the alternative that circumstances would arise where the said provision would be greater constricted.
He refuses to reason that a 21year old as at the second election would not be able to show up a voters ID and as a result the purpose and intent of the provision would be lost at the expense of internal party provisions that greatly violates the supremacy of the Article 94(1)(a) of the 1992 constitution.
2. On the issue of procedural lapse in filling the case at the apex court, I believe he should know enough to know that, it lies within the remit of a party to a case to decide the best way of justice and executing a suit when there are clear grounds of miscarriage of justice. Ezanetor felt threatened by a prejudiced stand by the high court judge hence its up to her to decide what best action would be face-saving.
3. On the grounds of interpretation and the Supreme Courrs supervisory role, his argument falls flat in the face of law. Here is an aggrieved party to a suit who feels embattled by a wrong interpretation of a provision of a constitution and proceeds to petition the apex court responsible for interpretation, what is so awkward about this that he can't fathom. There clearly two sides of the same coin with regards to the interpretation of the said article and an aggrieved party feels the Jutisdiction of the Supreme Court should be invoked, what is so complex about this, JJC Ennin Yeboah?
Are we not witnesses to a brawl in even the interpretation of a ruling from this same court ensuing between the state(EC) and an individual?

Justices must be appointed by a president.
Did justice Anim Yeboah reach his verdict because he was not appointed by President Mahama?
By the same token, we can conclude that this article is biased because the publisher is anti NDC.

If she goes on to win the parliamentary election in November, would she have met the constitutional provisions of article 94(1)? Yes
This is what matters as far as the constitution is concerned.
Dr Rawlings only gets disqualified if at the time of being an MP she does not statisfy 94(1).
Seeking approval from the NDC to contest does not make Dr Rawlings an MP. She is therefore not affected by 94(1) at this time. It is premature.
The constitution is silent on whether one should be a registered voter at the time of expressing interest and seeking approval from one's party to contest a parliamentary seat.
Dr Rawlings is merely seeking approval of her party to be their MP. She is not yet one and may possibly never be.
She has therefore done nothing wrong at this stage.

I am not sure where this judge learn his legal profession and who made him a supreme court judge? He has never made sense to me anytime he delivers judgement.he seems to be excessively stupid.
Sorry Oyo, Justice Yeboah appears to be the only reasonable and sensible person on the panel. If his judgement does not make sense to you, you must be the problem.
