in most of the advanced country Debt management court is open to everybody and it is established in every district
The main objectives of the debt management court is to first look at the case, access the strength of the accused and find out why he or she is not paying the debt.
then the management judge look at
the possibilities, and the agreements documents between the complainant and the accused..
if it is possible for the court to make a settlement plan - it does that.
if the judge think it is beyond the threshold of the debt management court , then it issued a certificate , so that the complainant could proceed to high court .
it is only in high court, that could ask the complainant to enforce the agreement -
normally we don't jailed the accused, the court find every possible way of retrieving assets that are in equivalent .
There must be a caution to everybody in the country when it comes to debt and court limitations
1. don't give your money or loan to any body if you are not convinced that the person could pay it.
2. family assets cannot serve as guarantee in any agreement it is only properties of the person in his or her name that could be accepted.
all these caution are very important that need national education because - that court can only put out a management and settling plan. it cannot goes beyond that.
any person who is given money out as a loan - must have a bad debt procedure in mind and must understand that- court after assessing the current situation and strength of the accused , and all the agreement documents and information could grant a bad debt judgement.
in this the person may spent only some months in prison and come out as free person.
all these are very important in debt managements because if the people no the procedure , then they becomes well equipped in understanding what is going to happen.

the moment the court issued a imprisonment certificate for the accused to be jailed- the amount involved has become a government debt.
it is the government who has to pay 50% of the quantum involved.-That is why the court must not always considered putting the accused in jail.
if you jailed the accused , without paying the money to the complainant you have caused more harm than good-
more so if you are taken the freedom of the accused into prison to work for you the government- it is fair to pay the debt. if not you the government has benefited while the complainant has lost his money , and has gain nothing .

The private persons who also give money as loan to other people must take note of this
that
if you don't have any accreditation to give loans,
you have little chances in retrieving the debt.

my advise to you is -
first
go to the magistrate court , seek an accreditation
that there is a situation in your community you want to help, so the court should help grant the agreement before you could give out the loan.- the Magistrate court may charge you a fee and call for guarantors before granting you the accreditation.
remember
if there is an interest attached to the loan- you must pay value added tax to the GRA.
in GHANA here there are a lot of people doing these type of business without paying tax ,
all these that I have said could sanitise the system
