Tsikata goes ahead to ask if witness is aware of the affidavits of Freda Prempeh an NPP MP. His question draws a banter between him and one of the judges who says that question is part of an application which he Tsikata has brought before the court asking leave of the court to cross-examine Prempeh who came by affidavits evidence. He says it is not right to ask questions of Bawumia on the same matter and expect to haul Freda Prempeh before the court to also ask her the same question.
Tsikata insists he has to ask the question. Atuguba asks him to go ahead but they will assess whether the question is fit to be answered by Bawumia before he will do so.

As to Tsatsu's show of disrespect to Counsel Addison, he was roundly condemned on the issue and even he regrets it (as mentioned by Ato-Dadzie).

I don't agree with Atuguba. He should have called Tsikata to order from day one when he started to ask questions tinged with politics. It is interesting he is asking Dr Bawumia to bring his mind to the court and I suggest that Atuguba should do likewise.

Lead Counsel for the third Respondent in the ongoing Presidential Election Petition Tsatsu Tsikata will have his tenth bite at the Cherie in an intriguing cross-examination of second petitioner Dr Mahamudu Bawumia.
It has been nine solid days wits, allegations of repetitive questions and dishonest answers and a hugely humorous but firm presiding Judge William Atuguba.
The Judges are expected to hand a "bad faith" ruling first thing when court resumes today.
Tsikata claims the petitioners' case is wrinkled in bad faith but Philip Addison objected to the accusation. He argued the counsel on the other side cannot make such accusation when he has not given any evidence or particulars of bad faith for the petitioners to respond.
The Judges for purposes of consistency, deferred ruling to today to make sure the ruling given in respect of this objection is in tandem with previous rulings on similar objections.
1005 am The judges have taken their seat at the bench.
The counsel introduce their team of lawyers to the bench beginning with the Petitioners, followed by the First, Second and Third Respondents.
Bawumia is reminded of oath as he takes his seat in the witness box.
1018 Ruling
The Judges have sustained the objection by the Philip Addison.
Atuguba explains that questions to which the objection is contained is in the paragraph of the respondents but adds that questions being asked delve into issues that have already been dealt with by the second respondent and for which reason the objection has been sustained.
Tsatsu continues with his cross examination. He asks witness to read portions of a document he tendered after which he suggests to witness that the claims in the document that the first and second respondent conspired to rig the election was not true.
Bawumia says that is not the substance of the case the petitioners brought before the court. He tries to veer into other areas in his answer but Judge Atuguba draws his attention to stick to precise answers.
Tsikata asks witness to read another portion of the document in which claims of fraud and criminality have been made against the first and second respondents. Bawumia reads, after which Tsikata suggests to him that the claims of fraud are untrue.
Bawumia says they are making claims of manipulations and violations of the electoral laws and not criminality and fraud.
Judges draw the attention of Tsikata to be cautious in his line of questioning. They say issues about fraud and criminality have been asked and answered and which will be dealt with at the bench anyway.
Tsikata says before the letter was written, some leading members of the petitioners had asked their supporters to go in white to church on a victory they have chalked. Bawumia says he is not sure about that.
Philip Addison raises an objection. He says the question is needless. It is a serious court and must be addressed as such.
Tsikata says he is entitled to ask the question and to get an answer.
Relevance
Philip Addison is up again. He says Tsatsu keeps asking irrelevant questions and when the witness begins to answer he is stopped in his tracks.
Presiding Judge Atuguba issues a stern warning. He says the issue about relevance can be determined by the bench and not by him. He says the court can be rigid if the lawyers want it so to be. In any case, he says the issue about election declaration is relevant to the court. He asks Addison to resume his seat.
Tsikata continues and asks a specific question about the General Secretary of the NPP declaring results in favour of the NPP. Bawumia says several NPP leaders made comments to that effect but that the only institution mandated in this country to declare results in the country is the EC.
Atuguba intervenes again asks Bawumia to stick to the question. He says people are approaching the case from two fronts- facts and politics. He asks Bawumia to bring his mind mind to the court, deal with the facts so the Judges will rule based on the facts.
Addison is up again. He says his client is being restricted from answering the question. He says the witness is expressing his opinion on the issue and must be allowed to do so.
Atuguba says it is within the rights of the Judges to direct the witness in his answers. He instructs Addison to resume his seat again.
Juaso Court Hall controversy
Tsikata continues his cross examination and picks a pink sheet for Juaso polling station. He says the polling agent is an Assembly member, a known member of the NPP and signed to the results in that polling station. He says there is no basis for queries of the results of the Juaso Court Hall.
Bawumia says there is every basis because there are three separate results for the same polling station which is highly irregular. Which of the results did the polling agent sign to? he asks.
Judges remind Tsikata that these questions have already come up in his cross examination. In any case they say these are issues that should be in the addresses to the court.

Bawumia says he is unable to answer that. Freda Prempeh is the best person possible to answer that question.
Ghost polling station
Tsikata brings out another letter purportedly written by the counsel of the petitioners which has an attachment of list of 22 ghost polling stations. He tenders and seeks to find out from the petitioners which polling station has been struck out of the allegations of ghost polling stations. He says the petitioners had in their initial petition alleged there were 23 of such polling stations and wants to find out which one of them has been struck out. Addison raises an objection. He says the list of 22 stations is clear on that letter which Tsikata is attempting to tender. He does not see why counsel will now ask witness whether or not there were 23 polling station and which one has been deleted.
Ruling
Once the number and identities of the ghost polling stations exhibited are not disputed by the Respondents in their affidavits there is no point for Tsikata in belaboring that issue. Objection Sustained, Atuguba rules; Addison thanks the panel; Tsikata continues with his cross examination.
Tsikata presents a list of 20 pink sheets to be perused by the lawyers.
After minutes of perusing the lists, Addison says his client needs to refresh his memory before he could answer the question. He says 20 pink sheets have been selected from over 11842 pink sheets and there has to look it up in the affidavits before answering.
Tsikata accuses Addison of preempting the answer by the witness. Atuguba agrees with Tsikata and asks Addison to allow the witness to answer the question without being given a hint.
The list of 20 pink sheets is given to Bawumia from which a question is asked. Bawumia says he has to refresh his memory on the over 11842 pink sheets before he will be able to answer the question. He says he will do so after lunch break.
Tsikata says the starting point of Bawumia's committee is to have the first petitioner declared winner of the election. That is not true, Bawumia says.
He says based on that starting point they made claims of malpractices, irregularities, violations just for the purpose of he wants to achieve and for the first petitioner to become the president.
Atuguba says the question is over flocked and over ruled.
Tsikata suggests that what Bawumia and his co-petitioner are seeking to achieve is what they could not achieve through the ballot box.
Atuguba over rules the question.
Tsikata says what the petitioners have claimed will be a subversion of the will of the people of Ghana.
He says in a similar way in 2009, his party went to court just after the election.
Bawumia says he is not quite sure the extent of legal proceedings on in 2009.
Tsikata says It is your practice to go to court when you lose an election.
Bawumia responds and says it is their legal right to go to court and that is not a crime.
You resort to this method when you have no basis, Tsikata asserts
We have come to court because there are violations and irregularities in the election Bawumia responds.
Tsikata suggests that the NPP has provided many stories bothering on the 2012 elections.
Atuguba says Tsikata questions are more of an address and not cross examination.
Tsikata again suggests to Bawumia that when the NPP loses election it resorts violence. Bawumia denies knowledge of that.
Tsikata says none of your claims before the court provide the basis for what you are asking the court to do.
Bawumia says they have shown the violations and irregularities the quantum of which will affect the declaration of the 2012 and for which reason there is enough basis to come before the court.
Tsikata says subject to the count of the pink sheet exhibits and answers to the 20 pink sheet which the witness wants to refresh his memory on, he will await those matters and then draw the curtain on his cross examination.
Atuguba announces a Special lunch break at 1145 for what has been an electric and intriguing day of cross examination.
1345 Court Resumes
Presiding Judge announces to the court a "certificate of good news" from KPMG to the court.
KPMG has agreed to conduct the audit of pink sheets free of charge.
Officials of KPMG who are in court are recognised and applauded.
Tsikata continues with his cross examination on the 20 pink sheets which the witness wanted to refresh his memory on.
