The national Institutions and the Government should be interested inthe well being of their citizens principally, making policies to innure to their well being.Some of the Nigerian Banks in the country are here basically to exploit the citizens especially FBNBank and should be carefully watched. Read on the following:
FBNBANK HAS DOUBTFUL BUSINESS ETHICS TO OPERATE IN GHANA
It is important for any one discussing a matter in court to be careful, noting especially the issues which are germane to the final determination of the case. However, one cannot ignore some blatant lies which have been submitted by the witness who happens to be the Head of Human Resource Department. In addition to these lies are contradictions and illegal conducts which were carried out by FBNBank Ghana. It is amazing for such a bank which has been operating banking business in Nigeria over a decade to commit such illegalities. The Bank’s Group Office recently offered some package to its employees who were not limited to age but finds it convenient to impose this wicked action on the Ghanaian subsidiary which is supposed to be part of the group. This goes to establish the point that the bank was out to cheat its employees in Ghana by imposing a scheme which is not known under our laws in the employer/employee relationship.
The Labour Law adequately makes provisions to guide this relationship and for the Head of Human Resource of a relatively big bank to totally ignore and employ something which is not grounded in law raises lots of questions. The question some of us are asking is whether the bank is not aware of these legal provisions or the bank was relying on something which many of us do not know.
Management submitted a proposal to the board for approval and after getting the approval decided not to discuss the matter with those on whose behalf the approval was received specifically the senior and junior staffs. There was a decision to pay off a section of the staffs who were 50 years and above in age and the only source some of these staffs could hear of this proposal was from the grape vine. There were those who did not hear of this proposal at all so could not avail themselves. Meanwhile the Labour Law provides that the employer should keep an open communication with the employee. The proposal was intended to target some employees so they were those who got knowledge of it. Are we not right to conclude that management did not mean well for the affected employees? The Head of Human Resource admitted that the scheme was voluntary and that the bank will decide who is granted access to the scheme. We should also not forget the Labour Law gives the employer the option to terminate employment if it can determine that an employee is incompetent and we know that the bank appraises its staff at least once every year. Why did the bank avoid the use of this method if the reason they advanced to the board was that the affected employees were unproductive and inefficient. Is it also true that it is only employees within this age group who are unproductive and inefficient?
Management apart from ignoring the Labour Law set aside the Collective Bargaining Agreement which it has agreed with the employees saying that the scheme they were introducing (which is not founded on any law) carries more weight because the employees themselves applied for it.What was the scheme? It says management members between the ages 50 and 59 years will be paid 24 months basic salary irrespective of the number of years one has worked with the bank whiles senior and junior employees will be paid 6 weeks basic salary for 2 years work. Management therefore claims that the scheme was beneficial to the employee than staying on to work till one attains the voluntary age of 60 years. Does this make sense to any reasonable person? The Labour Law explicitly provides that the employer should always protect the interest of the employee and where any contract has any provision which is not favourable to the employee, the CBA should apply. And where the contract is favourable over the CBA, the contract should apply. The Law is therefore mindful of protecting the interest of the employee.
There are lots of ridiculous lies and illegalities provided by the Head of Human Resource (Michael TettehVoetagbe) as witness to the defendant which will not be discussed on this platform to give the bank some clues. This will be sorted out in the courts.
When the question was asked earlier whether the bank did not know all these legal provisions or it was relying on something which we don’t know, we are aware the bank is hoping to use the influence of a former Minister of State and an NDC MP on its board to influence the course of justice in the bank’s favour. Let the bank know that this issue is not only an employer/employee concern but it is a National matter which many people are following. It is also encouraging to hear the Chief Justice advises Judges to ensure that the course of justice is not perverted as a result of monetary inducement and we are following very closely to the end of the case. We want to appeal to the Judge presiding to encourage speedy trial because many families have been affected especially concerning children attending school. The judge should take note of its own saying that justice delayed is justice denied.
We know the bank actually bribed some officials of the ICU and UNICOF to turn blind eyes on the open violation of the Labour Laws and the CBA it committed and thinks it is cheaper to bribe than do the right things according to the laws of the land. It also appears the board is in tacit agreement with the illegal actions of management since it helped to bank to prop up its profit.
We want to take this opportunity to emphasize a quotation from The Living Bible which states ‘’Woe to those who are heroes when it comes to drinking and boast about the liquor they can hold. They take bribes to pervert justice, letting the wicked go free and putting innocent men in jail.’’ (Isaiah 5:23 – 24). On the basis of this we want to assure the Head of Human Resource, the former CEO and all those including the bank who deliberately knew the truth but for the sake of cheating, imposed this fake scheme on the employees that the Almighty God will never forgive them. There were those who were also denied accessto the proposal after serving the bank several years with their toil and blood.
In the next edition, the whole country will be let into the flagrant abuses by the Integration Team from Nigeria in the initial stages of taking over International Commercial Bank. The Bank of Ghana which is the Supervising Authority was sleeping and these officials were abusing the country’s Foreign Exchange Regulations at the time the country was struggling to stabilize the currency. It is really amazing.
