As Justice Mohammed Habib Logoh read out the judgement dismissing the case brought by two “NPP” plaintiffs seeking an injunction against the October 18 presidential primary of the Party, alarm bells rang in court as the NDC lawyer representing the plaintiffs allegedly sent two text messages on the Court’s decision to NPP presidential aspirant, Alan Kwadwo Kyerematen.
This revelation was made in open court on Friday, 3rd October, 2014, to the dismay of NPP members and the general public, confirming the worst fears of many who had received reports, prior to the commencement of the case, that Mr. Alan Kyerematen was allegedly behind the lawsuit against his own party, the NPP.
According to sources in court, Lawyer Andy Appiah Kubi, who together with Lawyer Godfred Dame represented the NPP, whilst seated next to Eric Tieku, the NDC lawyer representing the “NPP” plaintiffs, saw two text messages being sent by Eric Tieku allegedly to Alan Kyerematen.
The first text sent to Alan Kyerematen from Eric Tieku apparently read: "It is not going well", a few minutes after Justice Logoh began reading his judgement.
Immediately after judgment was passed, Eric Tieku sent another text to Alan, which is said to have read "Case is dismissed."
This prompted Lawyer Andy Appiah Kubi, in open court and to the hearing of all gathered, to inform Justice Logoh that "My Lord, whilst you were reading, my friend on the other side (Eric Tieku) was sending text messages to some bigwigs in the NPP."
After proceedings in court were brought to an end, and in the presence of all in the courtroom, Lawyer Andy Appiah Kubi mentioned the name of the receiver of the text messages from Eric Teiku as Alan Kyerematen.
Surprisingly, lawyer Eric Tieku, also in open court, did not deny sending the text messages to Alan Kyerematen, but rather complained that Lawyer Andy Appiah Kubi had invaded his privacy, drawing sighs of disbelief from NPP members. He then remarked that Lawyer Appiah Kubi was “good BNI material.”
It will be recalled that on Friday, 26 September, 2014, it was revealed that Rexford Agyei Frimpong and Oppong Kyekyeku, the plaintiffs who were seeking to place an injunction on the NPP’s October 18 congress, were being represented by “hardcore fanatics” of the ruling National Democratic Congress (NDC), lawyers David Annan and Eric Tieku.
This development stunned members of the NPP and those present at the court, who wondered why so-called members of the NPP had employed the services of lawyers of the NDC to push for a postponement of the NPP presidential primary to elect its presidential candidate for the 2016 elections.
It will also be recalled that the application praying for an injunction to be placed on NPP primary came two clear days after Mr. Alan Kyerematen – the leading contender to Nana Akufo-Addo – at his campaign launch, through Nana Ohene Ntow and Dr. Richard Anane, gave explicit warnings to the NPP to extend the date of the congress, threatening that failure to do so would result in a lawsuit against the party.
